<br />This Second Amendment to the Declaration of Covenants, Conditions and Restrictions of Copper Creek

<br />A. The Declaration of Covenants, Conditions and Restrictions of Copper Creek Estates Subdivision
<br />was recorded by Copper Creek Esta.tes — Grand Island, L.L.C., on October 12, 2007, as Instrument #200708774
<br />("Declara.tion"). The Declaration encompasses the Copper Creek Estates Subdivision lots legally described as
<br />follows:
<br />Lots One (1) through Ninety-seven (97), inclusive, together with Outlots A, B, and C in Copper
<br />Creek Estates Subdivision, an Addition to the City of Grand Island, Ha11 County, Nebraska..
<br />B. The Declaration was amended by a First Amendment to the Declaration of Covenants,
<br />Conditions and Restrictions of Copper Creek Estates Subdivision, which was recorded by Copper Creek Estates --
<br />Grand Island, L.L.C., on Mazch 18, 2008, as Instrument #200802261, to designate a housing community within
<br />the Copper Creek Estates Subdivision as housing for older persons in compliance with the Fair Housing Act
<br />("First Amendment").
<br />C. Declara.nt desires to further amend the Declaration to eliminate the restriction that the use of the
<br />lots within the Copper Creek Estates Subdivision be restricted to modular homes built by Bonnevilla Homes�, a
<br />division of Chief Industries, Inc., or its successors or assigns, and to clarify certain other provisions.
<br />D. Declarant hereby executes this Second Amendment pursuant to its authority under Article V,
<br />Section 3, of the Declaration.
<br />E. This Second Amendment shall be effective on October 11, 2012 ("Effective Date").
<br />F. Declarant's Agreement for Prepaid Rebates with Chief Industries, Inc., which agreement was
<br />executed by Chief Industries, Inc., on September 2, 2005, and which agreement was da.ted September 26, 2005,
<br />and which agreement was referenced in Article V, Section 3, of the original Declara.tion, will be terminated prior
<br />to the Effective Date of this Second Amendment pursuant to a written agreement executed by Chief Industries,
<br />Inc.
