HazardousSubstances.Borrower shall uot cause or permit the presence, use, disposal, storage, or rclarsc <br /> of any Hazardous Subs[ances on or in the Property. Borrower shsll not do, nor aflow anyone else to do, <br /> anything afY'ceting the Property that is in violation of any Environmental Law.The preceding two sentences <br /> shall not apply to the presence, use,or storage on the Property of small quantities of Hazazdous Substanccs <br /> that are generally recognized to be appropriate to normal residcntial uses and to maintenance of the Property. <br /> Borrower shall promptly give Lender written notice of any invcstigation, claim,demand, lawsuit or other <br /> action by any govemmental or regulatory agency or private party involving the Property and any Hazardous <br /> Substance or Environmcntal Law of which Borro�ver has actual knowledge. If Borrower learns,or is notified <br /> by any governmental or regulatory authority,that any removal or other remediation of any Hazardous <br /> Substances affecting the Property is necessary, Borrower shall promptly take all necessary rcmedial actions <br /> in accordance with Enviroumeutal Law. <br /> As used in this parap,raph 16, "Hazardous Substances"are thosc substancesdefinedas toxic or hazardous <br /> substancesby Environmental Law and thc following substanccs:gasoline,kerosene,other flammable or toxic <br /> petroleumproducts,toxicpesticidesandherbicides,vola[ilesolvents,materialscoutainingasbestosor <br /> formaldehyde,and tadioactive materials.As used in this paragraph 16, "Enviroumcntal Lxw"mcans federal <br /> laws and laws of the juri sdiction whcre the Property is loc;atcd that rela[e to health,safety or environme�tal <br /> protection. <br /> Non-UniformCovenants.Bonower and Lender further covenai�t and agree as Follows: <br /> 17. Assignmentof Rents.Bonower uuconditionally assigns and transfers to Lender all the rents and revenucs <br /> of the Property. Borrowec authorizes Lender or Lender's age�ts to collect the rents and revcnues and hereby <br /> directs cach tenant of the Property to pay the rents to Lendcr or Lender's agents. However,prior to Leuder's <br /> notice to Borrower of Borrower s breach of any covenant or agreement in the Security Instrument, Borrowcr <br /> shall collcct and receive all rents and revenucs of the Property as trustee for the benefit of Lender and <br /> Borzower. This assignment of rents constitutes an a6solute assignment and not an assignment for additional <br /> security only. <br /> If Lender gives notice of breach to Borrower: (a)all rents received by Borrower shall be held by Aorrower <br /> as trustee for benefit of Lender only,to be applied to the sums secured by the Security Instrument (b) <br /> Lcnder shall bc cntitled to collcct and receive all of thc rents of the Property; and (c)each tenant of the <br /> Property shall pay all rents due and unpaid ro Lender or Lender's agent on Lender's wcitten demand to the <br /> tenant. <br /> Borrower has not execu[ed any prior assignment of the rents and has not and will not perform any xct that <br /> would prevent Lender from exercising its rights under this parabRaph 17. <br /> Lender shall not be required to enter upon,take control of or maintain the Property bcft�rc or after giving <br /> notice of breach to Borrowec Ho�vevcr, Lcnder or a judicially appointed receiver may do so at any time <br /> there is a breach. Any application of rents shall not cure or waive any default or iuvalidate any othcr right or <br /> rcmedy of Lcnder. This assignment of rents of the Property shall terminate when the dcbt sccured by the <br /> Security Instrument is paid in full. <br /> 18.
