<br />Personalty, or any other part of the Properiy or the Collateral Property, including any awards ox
<br />settlements resulting from {a) any action or procee�iing, however characterized or named,
<br />relating to any condemnation or other taking, or conveyance in lieu thereof, of a11 or any part of
<br />the Pz�operty or the Collateral Property, wheth.er direct or indirect (a "Condemnation Actian"),
<br />(b) any damage to the Properry or the Collateral Property caused by governmental action that
<br />does not result in a Condemnation Acrion, or (c) the total or partial talang of the Praperty, the
<br />Improvements, �lie Fixtures, the Personalty, or any ather part of the Property or the Collateral
<br />Properiy under the power of eminent domain or otherwise and incl�uding any conveyance in lieu
<br />thereof;
<br />8. Contracts.
<br />All contracts, options, and other agreements for the sale of the Property, the
<br />Improvements, the Fixtures, the Personalty, or any other part of the Property or the Collateral
<br />Property entered into by Debtor now or in the future, and any contract or other agr�ment for the
<br />provision of goods or services at or othez�w�se in connect�on with the opera�ion, use or management
<br />of the Properiy or the Improvements, including cash or securities deposited to secure performance
<br />by parties of their obligations;
<br />9. Rents.
<br />All rents (whether from residential or non-residential space), revenues and other income
<br />of the Property or the Improvements, iacluding subsidy payments received from any sources,
<br />including pa.yments under any "Housing Assista.nce Payments Contract" or other rental subsidy
<br />agreement (if any}, parking fees, laundry and vending machine income, and fees and charges for
<br />food, health care and other services provided. at the Property or the Collateral Property, whether
<br />now due, past due, or to laecome due, tenant security deposits, entrance fees, application fees,
<br />processing fees, community fees and any other amounts or fees forFeited. by any resident or
<br />tenant, together with and including all proceeds from any private insurance for residents to cover
<br />rental charges and charges for services at or in connectioz► with the Propez�ky or the Improvements,
<br />and the payments and the right to receive payments from residents or Medicaid pmgrams or similar
<br />federal, state or loc�1 programs, � boards, bureaus ar agencies, due for the rents or services of
<br />residen�s at the Property and Improvements;
<br />10. Leases.
<br />All present and future leases, subleases, licenses, concessions or grants ar other
<br />possessory in.terests now or hereafter in force, whether oral or written, covering or affecting the
<br />Property� or the Collateral Propez�ty, or any portion of the Property or the Collateral Property
<br />(including proprietary leases or occupancy agreements if Debtor is a cooperative housing
<br />corporation), and a11 mociifica.tions, extensions, or renewals thereof, all residency, occupancy,
<br />admission, and care agreements pertaining to residents of the Property and Improvements and also
<br />specifically, that certain. Lease Agreement dated as of Februaty lb, 2012, by and between TSMM
<br />Management, L.L.C. and Debtor, as amended by Amendment to Lease Agreement dated August 31,
<br />2012 (the "Leases") an.d a11 Lease guaranties, letters of credit and any other supporting
<br />obligation for any of the Leases given in connection with any of the Leases;
