. � <br />�01207884 <br />GUARDIANSHIP <br />I believe that this power of attorney confers adequate power <br />and authority for my Agent to manage my finances and to make all <br />necessary decisions concerning my health and my care. No <br />guardianship or conservatorship should be necessary. However, if <br />any guardianship or conservatorship proceedings are commenced to <br />have such a personal representative appointed for me, then I name <br />and nominate my Agent to be appointed in that capacity, to serve <br />alone and without posting any surety or any bond that might <br />otherwise be required. <br />DURATION OF POWERS <br />As used in this document the word Agent includes each of my <br />Co-Agents, jointly and severally. <br />I direct that while both of the Agents I have appointed by <br />this Durable Power of Attorney are serving as my Agents neither <br />may exercise any of the powers granted to them without the <br />concurrence of the other except if either of my Co-Agents is not <br />readily available the other may act alone with regard to <br />emergencies relating to my health. Also, if by reason of death <br />or resignation or any other reason one of them discontinues being <br />my Agent then the other of them may proceed alone with full <br />authority to exercise all powers granted herein as if he or she <br />had been the only Agent appointed by this Durable Power of <br />Attorney. <br />This is a Present Durable Power of Attorney which becomes <br />fully operative at the time of its execution and delivery to my <br />Agent and remains operative until revoked. <br />I do hereby revoke any and all Durable Powers of Attorney <br />heretofore executed by me. <br />LEGAL EFFECT <br />Any and all exercises by my Agent of the powers herein <br />granted to them shall be legally binding upon me and my personal <br />representatives to the same force and effect as if I had <br />personally exercised the power in the same manner. No person or <br />entity dealing with me through my Agent shall have any duty or <br />obligation to look beyond the plain meaning of the provisions of <br />this power of attorney and Sections 49-1545 through 49-1557 of <br />Nebraska Revised Statutes to determine the authority of my Agent <br />to do or to refrain from doing any particular act. <br />4 <br />
