Za.valeta, as Trustor, and Pathway Bank, Beneficiary, wherein Pathway Bank was � <br />named Trustee. This Deed of Trust was recorded July 1, 2008 in the Records of the Register of <br />Deeds of Ha11 County, Nebraska as Instrument No. 0200805642. <br />Pamela D. Andersen, Member of the Nebraska State Bar Association, has been appointed <br />successor Tnistee, pursuant to a Substitution of Trustee filed for record with the Register of <br />Deeds of Hall County, Nebraska. as Instrument No. 201205531. Hereinafter the Successor <br />Trustee, Pamela D. Andersen, Attorney at Law, will be refened to as GRANTOR <br />The GRANTOR in consideration of Fifly-five Thousand and no/100 Dollars ($55,000.00) and <br />other valuable consideration received from Pathway Bank, hereinafter GRANTEE, does hereby <br />grant, bargain, sell, convey and confirrn unto GRANTEE the following described real property in <br />Hall Cou.nty, Nebraska: <br />The SoutL Half (Sl/2) of Lots Fifteen (15) and Sizteen (1�, Block Seven ('n, Bogg's and <br />Hill's Addition to the City of Grand Island, Hall County, Nebraska, accordiung to the <br />recorded plat thereof which currently has the address of 1104 N. Broadwell Avenue, Grand <br />Island, Nebraska 68801. <br />To have and to hold the above-described premises together with all tenements, hereditatments <br />and appurtenances thereto belonging unto the GRANTEE, and to the GRANTEE' S successors <br />and assigns forever. <br />GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S successors <br />and assigns: <br />1. That Judith Lilianna Za.valeta, failed to pay the Beneficiary payments which were <br />contractually due, and the GRANTOR, at the request of the Beneficiary, elected to declare the <br />entire unpaid principal balance, together with interest thereon, at once immediately due and <br />payable. <br />2. That a Notice of Default was zecorded by GRANTOR on Ju1y 6, 2012, as Instrument Nuxnber <br />0201205532, in the records of the Register of Deeds, Hall County, Nebraska. Within ten da.ys <br />thereafter, a copy of the recorded Notice of Default was mailed to all parties entitled to notice, <br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Sta.t. Section 76-1008. <br />3. That Trustor, Judith Lillianna Zavaleta, failed to cure the default referenced in the Notice of <br />Default within 30 days after the recording of the Notice of Default. <br />4. Thax a Notice of Trustee's Sa1e was executed by GRANTOR. At least twenty (20) da.ys prior <br />to the date of sale, a copy of the Notice of time and place of the Trustee's Sa1e was mailed to a11 <br />parties entitled to notice, pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. <br />Section 76-1008. <br />5. GRANTOR published the Notice of Trustee's Sale, to be held September 14, 2012, at 9:30 <br />a.m., at the Hall County Courthouse, Grand Island, Nebraska, which notice was published in the <br />Grand Island Independent of Crrand Island, Nebraska, once a week for five (5) consecutive <br />weeks, commencing on August 9, 2012, and ending on September 6, 2012. The last publication <br />of Notice was at least ten (10) da.ys prior to the Trustee's Sale, held on September 14, 2012, and <br />said sale was not later than thirty (30) days after the last publication of Notice. <br />
