EXHIBIT C <br />MODIFICATIONS TO SECURITY INSTRUMENT <br />(Cross-Default and Cross-Collateralization: Multi-Note) <br />T'he foregoing Security Instrument is hereby modified as follows: <br />�Q120752ti <br />1. Capitalized terms used and not specifically defined herein have the meanings given <br />to such terms in the Security Instrument. <br />2. Section 1 of the Security Instrument (Defined Terms) is hereby amended by adding <br />the following new defuutions in the appropriate alphabetical order: <br />"Borrower Projects" means a11 of the properties owned by Borrower or Borrower <br />affiliate described on Exhibit D, atta.ched hereto, together with the Mortgaged <br />Property. <br />"Other Loan" means, individually and collectively, each additional loan extended <br />from Lender to Borrower or Borrower affiliate. <br />"Other Loan Documents" means the Other Security Instrument and any other loan <br />documents, including any Multifamily Loan and Security Agreement evidencing any <br />Other Loan. <br />"Other Security Instrument" means, individually and collectively, each <br />multifamily mortgage, deed of trust or deed to secure debt encumbering each of the <br />Borrower Projects (other than the Mortgaged Property) securing each Other Loan. <br />3. The following section is hereby added to the Security Instrument as Section 18 <br />(Cross-Default and Cross-Collateralization): <br />18. Cross-Default and Cross-Collateralization. <br />(a) Cross-Collateralization. <br />Borrower hereby agrees and consents that the Mortgage Loan is and sha11 be <br />collateralized and secured by each of the Borrower Projects. Borrower has executed <br />this Security Instrument and the Other Security Instrument and consents to the <br />recording of this Security Instrument and the Other Security Instruments against the <br />Bonower Projects.
