The undersigned Borrower has agreed to act as Trustor in the DEED OF TRUST <br />to which this writing is the Preface and wherein FARMERS TRUST & SAVINGS BANK, an <br />Iowa Banking Corporation, is the Beneficiary and which is hereinafter referred to as the Trust <br />Deed. <br />2. The undersigned Borrower knows that by virtue of the statutes of the State of <br />Nebraska the Borrower has the right to make a Designation of Homestead in the body of the <br />Trust Deed. <br />3. THE UNDERSIGNED BORROWER DOES HEREBY DISCLAIM THE RIGHT <br />TO MAKE A DESIGNATION OF HOMESTEAD IN THE BODY OF THE TRUST DEED. <br />4. The undersigned Borrower does hereby state that no part of Borrower's homestead <br />is presently or in the future will be situated upon the real estaxe described in the Trust Deed. 'The <br />undersigned Borrower understands this to mean that whether or not the undersigned Borrower is <br />presently residing upon the real estate described in the Trust Deed and whether or not the <br />undersigned Borrower hereafter establishes residence and a homestead upon any part of that real <br />estate during the time that the Trust Deed remains unsatisfied and a lien upon the real estate, <br />THE UNDERSIGNED BORROWER SHALL HAVE NO RIGHT TO MAKE A <br />DESIGNATION OF HOMESTEAD in the event of Trustee's sale under the power of sale <br />contained in the Trust Deed. <br />5. THE UNDERSIGNED BORROWER DOES HEREBY WAIVE BY THIS <br />WRITTEN ACKNOWLEDGMENT ANY AND ALL RIGHT TO MAKE A DESIGNATION <br />OF HOMESTEAD UPON ANY PART OF THE REAL ESTATE DESCRIBED 1N THE <br />TRUST DEED. The undersigned Borrower understands that the execution of this <br />acknowledgment constitutes the waiver of rights otherwise available for the purpose of affording <br />Borrower the opportunity to retain Borrower's homestead in the event of a default upon the Trust <br />Deed. <br />6. The undersigned Borrower represents that this Preface to Deed of Trust <br />constitutes a disclaimer of right to make a Designation of Homestead and a waiver of right to <br />make a declaration of homestead as provided for in paragraphs 3(a) and 3(b) of Section 4 of the <br />Nebraska Farm Homestead Protection Act.
