<br /> 21. HaZardousSubstances.As used in this Section 21: (a) "Tlazardovs S¢rhstnnces"are those substances
<br /> defincd as toxic or hazardous su6stances,pollntants,or wastes by N.nvironmental Law and the following
<br /> si�bstances: gnsoline, kerosenc,other flammable or toxic petrolcum products,toxic pesticides a�d herbiciJes,
<br /> volatile solvents, mateiials containing asbestos ox formaldehyde,and radioactive materials; (b)
<br /> "Environmental Law° means federal laws and laws of the jurisdiction where the Property is located that
<br /> relate to health, safety or euvironmental protection; (c) "Environmerztul Cleunup"iucludes any respouse
<br /> action, remedial actiou, or removal action, as defined in Environmental Law; and(d) an "Environ�ner�tal
<br /> Condition" means a condition that can cause, wntiibute to, oz otherwise triggei an Enviroumental Cleanup.
<br /> Borrower shali not cause or permit the presence, use, disposal, storage,or release of any Hazardoas
<br /> Substances,ar threaten to release any Hazardous Substances,on or in the Property. Bonowzr chall not do,
<br /> nor allow anyone else to do, anything affecting the Properfy(a)that is in violation of any Environmental
<br /> Law, (b)which crcates an Environmcntxl Condition,or(c)which,due to the presence,use,or release of a
<br /> Hazardous Substance, creates a conditiou that adversety affects the value of the Property. The preceding two
<br /> sentences shall not apply to the presence,use, or storage on the Property of small quantities of Hazazdous
<br /> Substances that xre generally recugnized to be approprixle W no�mal resiJential uses and to mxintenance of
<br /> thc Property(including,but not limitcd to, hazardous substa��ces in consumcr products).
<br /> Borsower shall promptly give Lender writte�notice of(a)any investigation, claim,demand, lawsuit or othec
<br /> action by any governmental or regulatory agency or private party involving the Property and any Hazardous
<br /> Subs[auce or Environmental Law of which Borrower has actual knowledge, (b)any Environmental
<br /> Condition, iucluding but not limited to,any spilling, leaking, discharge,release or tku�ea[of release of any
<br /> Hazardous Substance,and(c)any condition caused by the presence,use or release of a Hazardoos Snbstance
<br /> which adverscly affects the value of the Property. if Boirower leams,or is notified by any gnvemmental or
<br /> regulatory authoriry,or any privatz pa�ty,that any removal or other remediation of xny Hazardous Substance
<br /> affecting the Property is necessary, Borrower shall promptly take all necessary remedial actions in
<br /> accocdauce witli Ecrviroumental La�v.Nothing herein shall create any obligatio��oi�Leuder for an
<br /> Environmental Cleanup.
<br /> Non-Uniform Covenants.Rorrower and Lendcr covenant and agrcc as Y'ollows:
<br /> 22. Acceleration;Remedies.Lender shall gi�e notice to Borrower prior to acceleration followiog
<br /> Borrower's breach of aoy covenant or agreement in this Security Instrument(but not prior to
<br /> acceleration under Sectlon 18 unless Applicable Law provides otherwise).The notice shall specify: (a)
<br /> the default;(b) [he action reqoired to cure the defaulh, (c) a da[e, not less than 30 days from the date
<br /> the notice is given to Borrower,by which the default must be cured; and(d)that failure to cure the
<br /> default on or before the date speci5ed in the notice may result in acceleration of the sums secured by
<br /> this 5ecurity Instrument and sale of the Property.The uotice shall further inform Borrower ot lhe
<br /> right to reinstate after acceleration and the right to bring a court action to assert the nou-existence of a
<br /> default or any other defense of Borrower[o acceleration and sale.If[he default is not cured on or
<br /> beFore the date speciTied in the notice,Lender at its option may require immediate payment in full of
<br /> all sums secured by this Secarity Instrument without further demand and may invoke the power oF sale
<br /> and any other remedies permitted by Applicable Law.Lender shall be entitled to collect all expenses
<br /> incurred in pursuing the remedies provided in this Section 22,including,but not limited to, reasonable
<br /> attnrneys' fees and cnsts of title evidence.
