<br />This trust deed is made this 1st day of August, 2012, by and between
<br />James A. Swezey, a single man, and Nancy S. Swezey, a single woman, 11498 S.
<br />Hilltop Road, Doniphan, Nebraska 68832, hereinafter called Trustor, and William S. Dill,
<br />a member of the Nebraska State Bar Association, 229 North Main Street, Valentine,
<br />Nebraska 69201, hereinafter called Trustee, and Richard F. Duryea and Phyllis Duryea,
<br />husband and wife, as joint tenants and not as tenants in common, 416 North Hall
<br />Street, Valentine, Nebraska 69201, hereinafter called Beneficiary.
<br />FOR A VALUABLE CONSIDERATION, the receipt of which is hereby
<br />acknowledged, Trustor irrevocably grants and conveys to Trustee, IN TRUST, WITH
<br />POWER OF SALE, for the benefit and security of Beneficiary, the following described
<br />real estate (as defined in the Nebraska Revised Statutes, Section 76-201):
<br />East 36 feet 9 inches of Lot One of South Valentine, an Addition to the City of
<br />Valentine, Cherry County, Nebraska, AND
<br />Part of the Southeast Quarter of the Northeast Quarter of Section Eleven in Township
<br />Nine, North, Range Ten, West of the Sixth Principal Meridian in Hall County, Nebraska,
<br />more particularly described as follows: Beginning at the Southeast corner of the
<br />Southeast Quarter of the Northeast Quarter of Section Eleven in Township Nine, North,
<br />Range Ten, thence running Westerly parallel to the Northerly line of Section Eleven a
<br />distance of 295 feet, thence running Northerly parallel to the Easterly line of said
<br />Section Eleven a distance of 295 feet, thence running Easterly parallel to the Southerly
<br />line of said Section Eleven to the Easterly line of Section Eleven, thence running
<br />Southerly along and upon the Easterly line of Section Eleven, Township Nine, North,
<br />Range ten to the point of beginning.
<br />together with all tenements, hereditaments and appurtenances thereunto belonging,
<br />owned at or acquired after the date hereof (all of which is hereinafter called the "Trust
<br />Property"), to have and to hold on the terms and conditions hereinafter set forth:
<br />This trust deed secures the following:
<br />(a) A promissory nnte of every r�ate her�with in t�� �: i�cip�l sum of �246,812.00
<br />payable with interest according to its terms, and including as indebtedness hereby any
<br />instruments taken in refinancing, extending or renewing the note or any part thereof.
<br />(b) All other sums, with interest thereon, advanced in accordance herewith to protect
<br />the security of this trust deed. These sums include, but are not limited to, sums
<br />advanced for payment of taxes, insurance, abstracting, recording publication expense,
<br />court costs and expense of sale.

<br />Trustor contained in this trust deed and the promissory note.
