<br />EASEMENT AGREEMENT � �

<br />This Easement Agreement made and executed this L����day of July, 2012, by and
<br />between Roger E. Ada.ms and Shirley A. Adams, husband and wife, hereinafter referred to as
<br />"Grantor", and CENTRAL PLATTE NATURAL RESOURCES DISTRICT, a Nebraska body
<br />corporate and politic, hereinafter referred to as "Grantee".
<br />WITNESSETH:
<br />WHEREAS, Grantor is the owner in fee simple of that real estate generally described as:
<br />Part of the East Half of the East Half of the Southeast Quarter (E1/2E1/2SE1/4) of
<br />Section Twenty Seven (27), Township (12) North, Range Twelve (12) West of the
<br />6�' P.M., Hall County, Nebraska;
<br />WHEREAS, Grantee seeks to obtain a permanent easement for construction,
<br />maintenance, repair, and operation of floodway control dam and related structures over and upon
<br />that real estate described as:
<br />A parcel of land located in the East Half of the East Half of the Southeast Quarter
<br />of Section Twenty Seven (27), Township Twelve (12) North, Range Twelve (12)
<br />West of the 6�` P.M., Hall County, Nebraska, being described as follows:
<br />Referring to the Northeast corner of the East Half of the East Half of the
<br />Southeast Quarter of Section 27; thence S88°47'27"W (Assumed bearing) on the
<br />North line of said east Half of the East Half of the Soi�theast Quarter, a distance of
<br />416.99 feet to the point of beginning; thence continuing S88°47'27"W, on said
<br />North line, a distance of 9.85 feet; thence S73°12'32"W, a distance of 26.27 feet;
<br />thence 536°19'S2"W, a distance of 23.90 feet; thence S63°26'42"E, a distance of
<br />46.47 feet; thence N21°25'S4"E, a distance of 13.04 feet; thence N73°50'06"E, a
<br />distance of 45.83 feet; thence S84°26'28"E, a distance of 37.79 feet; thence
<br />N89°15'17"E, a distance of 12.84 feet; thence N00°49'S3"E, a distance of 14.88
<br />feet; thence N81°52'08"W, a distance of 32.41 feet; thence S74°18'31"W, a
<br />distance of 25.94 feet; thence N68°07'S0"W, a distance of 37.50 feet to the point
<br />of beginning, containing .07 acres, more or less.
<br />hereinafter referred to as the "Permanent Flood EasemenY' as depicted on Exhibit "A" hereto;
<br />and,
<br />WHEREAS, Grantor is willing to grant such Permanent Flood Easement to the Grantee,
<br />its successors and assigns for the purposes of constructing, maintaining, repairing, operating,
<br />patrolling, and replacing a flood control dam and related structures to be situated in the bounds
<br />of the Permanent Flood Easement, subject to the condition that all obligations herein required are
<br />performed;
<br />THEREFORE, in consideration of the mutual covenants contained herein, it is agreed:
