<br /> This instruinent, made this 18�' day of January, 2012, between Eric H. Lindquist, a
<br /> member of the Nebraska State Bar Association, Successor Trustee, hereinafter called
<br /> "Grantor", pursuant to a power of sale contained in that certain Deed of Trust recorded on
<br /> October 31,2007 as Inshuinent No. 0200709321 in the office of the Register of Deeds of Hall
<br /> County, Nebraska, and the Secretary of the Department of Housing and Urban
<br /> Development, hereinafter called"Grantee".
<br /> WHEREAS, on October 14, 2011, Grantor, executed a Notice of Default pursuant to
<br /> which notice was given to Lance A. McDonald and Jamie R. McDonald, husband and wife,
<br /> Trustors, under that certain Deed of Trust recorded on October 31, 2007 as Instrunient No.
<br /> 0200709321 in the office of the Register of Deeds of Hall County, Nebraska, covering that
<br /> certain premises described as:
<br /> THE NORTH THIRTY (30) FEET OF LOT ELEVEN (11) AND THE
<br /> SOUTH FIFTEEN (15) FEET OF LOT TWELVE (12), BLOCK TWO
<br /> (2),FIRST ARTISTIC HOMES ADDITION TO THE CITY OF GRAND
<br /> ISLAND, HALL COLTNTY,NEBRASKA,
<br /> that a breach of an obligation for which the trust property was conveyed had occurred, and
<br /> setting forth the nature of such breach and of his election to sell or cause to be sold such
<br /> property to satisfy the obligation. Said Notice of Default was filed for record in the Office of
<br /> the Register of Deeds of Hall County, Nebraska, on October 14, 2011, as Instrument No.
<br /> 201107694.
<br /> A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br /> pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008.
<br /> Subsequent thereto,beginning on November 30, 2011, Grantor caused to be published
<br /> in the Grund Islund Independent, a newspaper ha�ing a general circulation in Hall County,
<br /> Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and
<br /> stating that the described property would be sold at public auction to the highest bidder for
<br /> cash or certified or cashier's check, at the lower level lobby of the Hall County Courthouse,
<br /> 1 st & Locust Street, Grand Island, Hall County, Nebraska at 2:00 p.m. on January 17, 2012.
<br /> Publication of such notice was made for five consecutive weeks on November 30, 2011,
<br /> December 7, 2011, December 14, 2011, December 21, 2011 and December 28, 2011, the last
<br /> publication being at least ten (10) days but not more than thirty (30) days prior to the date of
<br /> sale.
<br /> A copy of such notice of the time and place of sale was thereafter mailed to a11 parties
<br /> entitled to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat.
<br /> §76-1008.
<br /> Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Grantor,
<br /> did at the tune and place mentioned in said Notice of Trustee's Sale, offer said property for
<br /> sale at public auction, and did sell the same to Flagstar Bank, FSB for the sum of$44,085.68,
