A .v � SMALL ESTATE AFFIDAVIT FOR SUCCESSION OF REAL PROPERTY AS PROVIDED BY SECTIONS 30-24.125 AND 30-24,129 RRS NEBRASKA. LAWS 2010, �� L.B. 650. SEC°l'ION 2 /J� The undersigned Paul A. Lemke being first duly swom on oath, deposes and states as follows: 1. That Affiant is the surviving spouse of Linda Lemke, also known as Linda Kay Lemke and Linda K. Lempke who died intestate at Kapaa, Kauai, Hawaii on November 20, 2007, owning the following described property: An undivided one-third (1/3) interest in Lot One (1) Ed Ross Subdivision No. 3 in Hall County, Nebraska, known as 4943 N. St. Paul Road, Grand Island, Nebraska 2. The value of the Decedent's one-third (1/3) interest in the above-described real property is the sum of Fifteen Thousand Eight Hundred Twenty and 00/100 Dollars ($15,820.00). The entire property was valued by the Hall County Assessor on the County Assessment rolls at Forty-Seven Thousand Four Hundred Su�ty and 00/100 Dollars ($47,460.00) for the year 2007, the year in which the Decedent died. 3. Decedent left surviving her spouse, Paul A. Lemke bom 6/5/60 and two sons, Paul N. Lemke born 1/8/90 a.nd Taylor K.A. Lemke bom 11/23/95, both residents of Ka.uai, Hawaii. 4. More than thirty (30) days have elapsed since the death of the Decedent, as shown by the original of the Decedent's Death Certificate issued by the State of Hawaii, Department of Health on the 20th day of November, 2007, and hereto atta.ched and marked as Exhibit "A" and made a part hereof. 5. No Application or Petition for Appointment of a Personal Representative is pending or has been granted in any jurisdiction. 6. Applicant as the claiming successor is entitled to Decedent's above-described real property by reason of the statutes of the State of Nebraska. The Decedent left �ant as surviving spouse and two sons above named; that pursuant to the Nebraska statutes above described, Affiant as surviving spouse is entitled to claim the first Thirty Thousand and 00/100 Dollars ($30,000.00) of property owned by the Decedent and does hereby claim the above-described real property as part of that allowance.
