201205395 <br />For the Pnrpose of Securing: � <br />t#. Payment of indebtedness evidenced by the Second Promissory Note of Tn�stor. ia the amount of $ 1,300.00 <br />in favor of Beneficiary (the "Promissory Note'�; and <br />B. Payment of all sums advaaced by Beneficiary to protect the Trust Estate. <br />The indebtedness descn'bed in paragraphs A and B abave is referred to as the "Indebtedness." <br />This Second Deed of Trust, the Promi�ssory Note of Trustor ia favor of Beneficiary and any other instrvment given to <br />evidence or further seciue the payment and performance of any obligation secured hereby are teferred to collectively as the <br />"I.aan lnstruments". <br />Tn�stor covenants that (� Trustor holds title to the Trust Estate and has lawful authority to encnmber the Trust Estate, <br />(u) the Tn�st EstaYe is free and clear of all liens and encumbrances except for easements, res�ictions and covenants of record and <br />the Deed of Tn�st from•Trustor encumbering the Property dated on or about the dale hereof (the "First Deed of Trust'�, and <br />(iii) Tnutor will defend the Tn�st Estate against the lawful claims of any person. <br />To Protect the Security of tfiis Second Deed ofTrust: <br />1. Payment of Indebtedness Trustor shall pay when due the principal o� and the interest oq the Indebtedness <br />and all othez sums as provided in the Loan Insfiunents. <br />2. Taxes Tnrstor shall pay each installment of all taxes and special assessments of every kiad, now or fiereafter <br />levied against the Trust Esmte or any part thereo� before delinquency, without notice or demand . <br />3. Insuranee and Repai�x Tnasbor shatl main ain ��d exteaded coverage in�,TM�+nce insuring the <br />Improvements constituting part of the Trust Estate for such amounts and on such terms reasonably �tisfactory to Beneficiary. So <br />long as the Property is secured by a first deed of tmst or mortgage, compliance with the insurance requirements of tha Fust Deed <br />of Tmst or mortgage shall be sufficient to sarisfy the requirements of this patagraph 3 relating to in�,m�++ce, <br />Trustor shall prompdy repair and ieplace the Tn�st Estate or any part thereof so tha� except far ordinary wear and tear, <br />the Trust Estate shall not deteriorate. In no event sbell the Tnistor commit waste on or to the Trust Estate, or commit, suffer or <br />permit any act to be done in or upon the Tnist Estate in violation of any law, ordinance or regulation. Trustor shall pay and <br />promptly discharge ax Trustor's cost and expense all liens, encumbrances and chacges levied, imposed or as5essed agamst the <br />Tsvst Estate or any part thereo£ • <br />4. Actions Ajfecting Trust Estate Tr�stor shall appeaz in and contest aay actioa or proceediag pucporting to <br />affect the security hereof or the rights or powers of Berieficiary or Tn�stee, and shall pay all costs and expenses, including cost of <br />evidence of title and attorneys' feea, in any such action or proceeding in which Beneficiary or Tmst� may appear. If Trustor <br />fails to meke any payment or to do azry act as and in the manner pravided in any of the Loen Instruments, Baneficiary and/or <br />Trustee, each in their own discretion, without obligation so to do and without nofice to or demand upon Tn�sWr and without <br />releasing Trustor from any obligation, may make or do the same ia such manner and to such extent as either may deem necessary <br />to protect the aecurity hereof. Trnstar shall, immediately upon demend therefor by Beneficiery, pay all costs and expenses <br />iacurred by Beneficiary ia connec6on with the exercise by Beneficiary of the foregoing rights, including without limitation costs <br />of evidence of title, court costs, appraisa(s, surveys and attorneys' fees. <br />5. E»unent Domadra If the Tnut Estabe, or any part thereof or interest therein, be taken or dameged by r8eson <br />of any public improvement or condemnation proceeding, or in any other manner including deed in lieu thereof <br />("Coademnation'�, or. if Trustor receives azry notice or other informa.tion regarding such proceeding, Trustor shall give prompt <br />written notice thereof to Beneficiary. Tnutor shatl be entifled to all compensation, awards and other payments or relief :thereof <br />and shall be entided at its option to commence, appeaz in and prosecute in its own name any action or proceedings. Tnutor shall <br />also be entided to make any compromise or settlemeat in connection with such taking or damage. <br />6.
