<br />AFFIDAVIT OF LAWRENCE E. ROESLER

<br />The undersigned, Lawrence E. Roesler, Affiant, upon being first duly sworn, hereby deposes and states as
<br />foiioWS:
<br />1. Affiant presently resides at 6125 South 25�' Street, Lincoln, Nebraska 68512. Affiant is the
<br />surviving spouse of Frances A. Roesler (hereinafter the "Decedent"), who prior to her death, signed and created the
<br />the Frances A. Roesler Revocable Trust under a written Trust Agreement dated October 28, 1992. Frances A.
<br />Roesler was the originally named therein to serve as the initial acting Trustee of this Trust. By the terms of this
<br />Trust Agreement, upon the death of Frances A. Roesler, Pamela Sue Roesler, the daughter of Frances A. Roesler,
<br />was appointed to act as the inirial 5uccessor Trustee of this Trust. Pamela Sue Roesler remains the current acting
<br />Successor Trustee of the above referenced Frances A. Roesler, Revocable Trust, which is now irrevocable due to the
<br />death of Frances A. Roesler.
<br />2. On October 23, 1992, Affiant and the Decedent signed a Quitclaim Deed listing the following two
<br />properties therein, which was recorded in the Register of Deeds Office of Hall County, Nebraska on December 7,
<br />1992 as Instrument No. 92-110501. The legal descriptions of the two properties listed in this Quitclaim Deed aze as
<br />follows:
<br />a. Lot 6, Block 40, Russel Wheeler's Addition to the City of Grand Island, Hall County, Nebraska, more
<br />commonly known as 104 East 11� Street, Grand Island, Hall County, Nebraska; and
<br />b. Lot 5, Block 1, Claussen Country View Addition, City of Grand Island, Hall County, Nebraska, more
<br />commonly known as 409 and 411 East Bismark, Avenue, Grand Island, Hall County, Nebraska.
<br />This Quitclaim Deed transferred an undivided one-half interest in both of these properties stated above to the
<br />Grantee named there as"Lawrence E. Roesler, Trustee of the Frances A. Roesler Revocable Trust dated the 28�' day
<br />of October, 1992: '
<br />3. Affiant hereby states the foregoing Quitclaim Deed was done incorrectly, as Affiant, Lawrence E.
<br />Roesler, was not named in the above referenced Trust Agreement to act as the Tntstee of the Frances A. Roesler
<br />Revocable Trust. As stated above, Affiant hereby confirms Frances A. Roesler was appointed in the Frances A.
<br />Roesler Revocable Trust to act as the initial Trustee and was serving in that capacity after the execurion by the
<br />Decedent of the Frances A. Roesler Revocable Trust.
