ASSIGNIlVG AND SUBLETTING: Tenant specifically has the right to sublease or <br />assign any part of the Fann without any prior approval by the Landlord. <br />7. ADDITIONS OR ALTERATIONS: Tenant will has the right to make a11 alternations <br />necessary to the land in order to perform farm and ranch operations. Specifically but not limiting <br />to, the Tenant has the right to drill a well and add a pump and pivot for irrigation purposes. <br />Landlord waives any claim to any item that may be argued to be a fi�cture upon the land. <br />8. TIlVIE IS OF TI� ESSENCE Time is of the essence of this Lease. <br />9. NO ESTOPPEL FROM LANDLORD'S WAiVER: No waiver by Landlord of the <br />breach of performance of any term of this Lease by Tenant constitutes a further waiver of any <br />other breach of performance by Tenant. <br />10. LANDLORD'S WARRANTY OF RIGHT TO LEASE: Landlord warrants that he <br />has the right to lease the Farm and will defend Tenant's possession of the Farm during the lease <br />term. <br />11. USE OF FARM BY TENANT: Tenant shall occupy and use the Farm only for fazm <br />purposes. <br />12. LEASE CONTAINS ALL AGREEMENTS: This Lease contains a11 the agreements <br />of the parties and fu11y expresses all of the terms of their agreement. <br />13. CHANGE OF LEASE TERMS MiJST BE IN WRITIl�TG: This Lease can be <br />amended, changed or modified only by agreement in writing signed by Landlord and Tenant. <br />14. BINDING EFFECT OF LEASE All of the terms of this Lease bind and benefit the <br />Landlord, each of the Tenants, and the heirs, personal representatives, and assigns (if Landlord <br />gives written consent to assignment of this Lease) of Tenant. <br />15. LEASE SIGNED IN DUPLICATE: This Lease is signed in duplicate so that both <br />parties have a duplicate original of the Lease. <br />
