2U12U417� <br />If the power of sale is inwked, Trustea shall record a notica of default in each connty in which aay <br />part of the Proparty is located and ahall mail copias of snch notice in tha mannar pr�cr�ed by <br />Applicabla Law to Borrower and to the other parsona prescrbed by Applicabla Law. After the time <br />reqwtred by Applicabla Law, Trustee shall giva public notica of sale to the parsons and in tha mannar <br />prescrbed by Applic�ble Law. Trustea, without demand on Borrower, shall sell tha Property at pnblic <br />auction to tha highest biddar at the time and place and nnder the terms dasignated in tha notic� of sale <br />in one or more parcals and in any order Trustea detarmines. Trustea may postpone sale of all or any <br />parcel of the Property by public announcemant at the time and place of any previously achednled sa1e. <br />Lendar or its deaignea may purchase the Proparty at any sale. <br />Upon recaipt of payment of tha prica bid, Trustee shall delivar to tha pnrchasar Trustee's de�ed <br />conveying tha Property. The recitals in the Trustee's deed shall ba prima facie avidenca of the trnth of <br />tha statements mada therein. Truatea ahall apply the proceeds of the sala in the following ordar: (a) to <br />all costs and expenses of exercising tha power of sale, aad the sale, inclnding the payment of the <br />Trustee's fe,� actually incnrred and reasonable attornays' fe� as permitted by Applicabla Law; (b) to <br />all sums secured by this Security Instrumant; and (c) aay exc�ss to the person or persons lagally <br />entitled to it. <br />23. R�onveyance. Upon payment of all sums secured by this Securlty Instr�ment, Lender shall request <br />Trustee to reconvey the Property and shall surrender this SecurIty Inshvment and all notes evidendng debt <br />secured by this Securlty Instrument to Trustee. Trustee shall reconvey the Property wlthout warranty to the <br />person or persons legally entided to it. Such person or persons shall pay any recordaflon costs. Lender may <br />charge such person or persons a fee for reconveying the Property, but only if the fee is paid to a th9rd party <br />(such as the Trustee) for services rendered and the charging of the fee is permitted under Applicable Law. <br />24. Substitute Trustee. Lender, at its opflon, may from time to time remove Trustee and appoint a successor <br />hvstee to any Trustee appointed hereunder by an instrument recorded in the county in which this Securlty <br />Instrument is recorded. Without conveyance of the Pmperty, the successor trustee shall succeed to all the <br />Hfle, power and du8es conferred upon Trustee herein and by Applicable Law. <br />25. Request for NotlCes.
