<br />Time is of the Essence. Time is of the essence in the performence of thia Deed of Trust.
<br />Waiver of Homestead Exemption. Trustor hereby releases and waives all rights and benefits of the homeatead
<br />exemptton laws of the State of Nebreske as to ell Indebtedness secured by this Deed of Trust.
<br />DEFINITIONS. The following words shall have the following meanings when used in this Deed of Trust:
<br />Beneflctary. The word "Beneficiery° meens Ftve Pointa Benk, and its succeasors end essigna.
<br />Borrower. The word "Borrower" meens JEFFERY T WATTIER and JAIME M WATTIER and includes all co-signars
<br />and co-mekers signing the Credit Agreement and all their auccessors and assigns.
<br />Credh A reemeM. The words "Credit Agreament° mean the credit agreement dated May 7, 2012 with crodit
<br />limit o � $25,000.00 from Truator to Lender, together with all renewels of, extensions of, modiflcations of,
<br />refinancings of, consolidations of, and substitutions for the promissory note or egreement. The maturity date of
<br />thia Deed of Trust is .
<br />Deed of Trust. The words "Deed of Trust" mean this Deed of Trust among Trustor, Lender, end Trustee, end
<br />includes without limitation all essignment and security interest provisiona relating to the Personal Property end
<br />Rents.
<br />Environmentel Laws. The words "Environmentel Laws" mean any and all state, federal end local stetutes,
<br />regulations and ordinances relating to the protection of human health or the environment, including without
<br />limitetion the Comprehensive Environmental Response, Compensation, and Liebility Act of 1980, as amended, 42
<br />U.S.C. Section 9601, et seq. ("CERCLA"!, the Superfund Amendmenta and Reauthorization Act of 1986, Pub. L.
<br />No. 99-499 ("SARA"1, the Hazardous Materials Transportetion Act, 49 U.S.C. Section 1801, et seq., the Reaource
<br />Conservation and Recovery Act, 42 U.S.C. Section 6901, et seq., or other applicable state or federal laws, rules,
<br />or regulations edopted pursuant thereto.
<br />Event of Defeult. The words "Event of Default" mean any of the events of defeult set forth in this Deed of Truat in
<br />the events of default section of thia Deed of Trust.
<br />Extstlng Indebtedness. The wo�da "Existing Indebtedness" mean the indebtedness described in the Existing Liens
<br />provision of this Deed of Trust.
<br />ImprovemeMs. The word "Improvements" means all existing and future improvements, buildings, structurea,
<br />mobile homes affixed on the Real Property, facilities, edditions, replecements and other construction on the Real
<br />Property.
<br />Indebtedness. The word "Indebtedness" means ell pr(ncipel, interest, and other amounts, costs end expanses
<br />payeble under the Credit Agreement or Related Documenta, together with elf renewals of, �xtensions of,
<br />modifications of, conaolidations of and substitutions 'for the Credit Agreement or Related Documenta and any
<br />amounts expended or advanced by Lender to discharge Truator's obligations or expenses Incurred by Truatee or
<br />Lender to enforce Trustor's obligations under this Deed of Truat, together with -i�tersst an such amounts es
<br />provided in this Deed of Trust.
<br />Lendar. The word "Lender" means Five Points Bank, ita succeasors and asslgns. The worda "successors or
<br />assigns" meen any peraon or company that ecquires any interest in the Credit Agreement.
<br />Parsonal Proparty. The words "Peraonal Property" mean all equipment, fixtures, end other erticles of peraonal
<br />property now or hereafter owned by Trustor, and now or hereafter atteched or affixed to the Real Property;
<br />together with all accessiona, parts, and additions to, ell replacements of, and all subatitutions for, any of such
<br />property; end togather with all proceeds (including without flmitation all insurence proceeds and refunda of
<br />premiums) ftom any sale or other disposition of the Property.
<br />Property. The word °Property" means collectively the Real Property end the Personal Property.
<br />Real Property. The worda "Real Property" mean the real property, interests and rights, ea further described in this
<br />Deed of Trust.
<br />Releted Documents. The words "Related Documents" mean all promissory notes, credit agreements, loan
<br />egreements, environmentel agreements, guaranties, security agreements, mortgages, deeds of trust, security
<br />deeds, collaterel mortgages, and all other instrumenta, agreementa and documents, whether now or hereafter
<br />existing, executed in connection with the Indebtedness.
<br />Renta. The word "Rents" means all present and future rents, revenuea, income, tssues, royalties, profite, and
<br />other benefits derived from the Property.
<br />Trustee. The word "Trustee" means Five Points Benk, whose eddress is P.0 Box 1607, Grend Islend, NE
<br />68802-1607 and eny substitute or successor trustees.
<br />Trustor. The word "Trustor" means JEFFERY T WATI'IER and JAIME M WATTIER.
