CONFIRMATION OF RIGHT TO, ATTACH TO EXISTING WALL <br />This agreement made and entered into this day of <br />040f"t ____,1960, by and between Masonic Templecraft <br />Association of Grand Island, a nonprofit corporation, herein- <br />after referred to as the CORPORATION; Emil F Roeser and Frieda <br />H. Roeser,'husband 'and wife, as joint tenants and 'Oscar F. Roeser <br />and Ella M. Roeser, husband and wife, as joint tenants, herein. <br />after referred to as the ROESERS; and Equitable Building &' Loan <br />Association of Grand Island, a corporation, as the MORTGAGEE. <br />WHEREAS, the corporation is the owner of and the Mortgagee <br />is the holder of a mortgage upon, a multiple story building partly <br />located upon the southerly forty -four feet of the westerly seven- <br />teen and one -half feet of lot three in block 66 in the original <br />town, now City, of Grand Island, Nebraska; <br />WHEREAS, The Roesers are the owners of a building located <br />upon the Westerly two - thirds excepting the area first above des- <br />cribed, of such Lot Three in such Block Sixty -six; <br />WHEREAS, the building belonging to such Roesers has,: utilized <br />since about the erection of the building belonging to the corporation <br />to the height of fourteen feet above the ground level and including <br />the foundation and basement wall below the ground level, the walls <br />of the Corporation's building from the intersection of the west <br />line of such lot three for a distance of seventeen and one -half <br />feet and thence southerly to the south line of such lot three; <br />such use being in the nature of a party wall use; <br />NOW THEREFORE, in consideration of the substantial union <br />of the building belonging to the Corporation and the building <br />belonging to the Roesers, and, in consideration of the mutual <br />interest of such parties in providing for the contingencies <br />of deterioration,.or substantial or total damage or destruction <br />from fire, tornado., act of God, explosion, atomic blast, or <br />otherwise, of all or part of the walls of the building of the <br />Corporation, such masonic Templecraft Association of Grand Island <br />hereby grants and confirms unto such Emil F. Roeser and Frieda <br />H. Roeser, husband and wife, as joint tenants, and Oscar F. <br />Roeser and Ella 144. Roeser, husband and wife, as joint tenants, <br />and to their assigns, and to the heirs and assigns of the sur- <br />vivor of them, except as hereinafter provided, the use forever <br />of the easterly seventeen and one -half (17V21) feet of the northerly <br />wall, and of the easterl wall of the Corporation's building, <br />to a height of fourteen 441) feet above the ground level together <br />with the foundation and basement walls thereunder, as such walls <br />now exist but without right to make any change, alteration or <br />insertion therein not- now existing. <br />.o_ <br />
