AGREEMENT FOR PROTECTIVE COVENANTS, RESTRICTIONS' <br />AND CONDITIONS FOR ROUSH SUBDIVISION. a <br />Re- Subdivision of the North 543.0 <br />feet of Lots One Through Fifteen, <br />inclusive, of Matthews Subdivision <br />�of Fart of the Northwest Quarter <br />(NW J) of Section Twenty -seven (27) <br />in Township Eleven (11) North. Range <br />(9), W sot of the 6th P. m. <br />WHEREAS the undersigned are the owners of all lots in Roush Subdivision: <br />A Re- Subdivision of the North 543.0 feet of Lots One Through <br />Fifteen inclusive, of Matthews Subdivision of Part of the North - <br />west i' quarter (TT Z') of Section Twenty-seven (27) in Township <br />Eleven (11) North, Range Nine (9), west of the 6th p. m. <br />shown on the plat heretofore filed in the office of the Register of deeds in Hall <br />County, aweu� aska and; <br />the owners ay.,e desirous of maintaining said subdivision as a <br />residential area, <br />NOW, THFREFORE, In consideration of mutual covenants and any po -raon or <br />persons, their heirs, admivistrators, executors and assigns, who may hereafter be- <br />comethe owners of any of such lofts it is hereby stipulated and agreed between the <br />undersigned present owners of such lots that the present owners and all future owners <br />shall be subject to the following protective covenants, restrictions, and conditions, <br />all of which shall ruin with the land as follows: <br />1. All 'Iota in the Subdivision shall be known and described as <br />residential logs. 'No apartment house, duplex, or triplex shall <br />be built on any lot, nor shall any basement house be built on any lot. <br />No structure shall be errected, altered, placed or permitted to <br />remain on any lot other than ore detached one -story dwelling and a <br />private garage for not more than three cars, and other secondary <br />buildings incidental to the residential use of the plot. l+to dwelling <br />shall be erected for occupancy of more than one family, nor shall <br />any dwelling be ased for occupancy of more than one family. No <br />commercial or business enterprise shall be conducted or operated <br />in sAd Subdivision. <br />2. All frame buildings other than the main structure shall have the <br />same quality of outside wall finish and roof as that approved for <br />the residence. No such building can be made cf unsightly mater- <br />ials, or boxes or similar lumber. <br />t• <br />3. All buildings shall be placed _ff+f+'±3 _&) feet back from the front <br />lot line of any lot, and all lots, including corner lots, except <br />Block three (3) and four (4), shall be considered to run east and <br />vest; frontage of lots shall be considered as that portion abutting <br />upon north -south streets. Any building permitted upon any lot <br />shall be at least ten (10) feet from the sides of said lot, any de- <br />tached garage or separate secondary structure shall also be not <br />less than forty '40) feet back from the front lot line and ten (10) <br />feet from any side lot line. <br />-1- <br />47.5' <br />
