,M -L <br />E A S E M E N T <br />WHEREAS, Ernest L. Walker and others who own the lots, tracts <br />and parcels of land in Walker's Subdivision, an Addition to the <br />City of Grand Island, Nebraska, have filed a petition with the <br />Mayor and City Council to create a sanitary sewer district so that <br />the lots, tracts and parcels of land in said Walkers Subdivision <br />can be connected with the sanitary sewer system of the City, and <br />WHEREAS, in order to provide said Walker's Subdivision with a <br />sanitary sewer main it is necessary that an easement, or right -of- <br />way, on which to construct public utilities be secured over, along <br />and across a tract of land lying beyond the corporate limits of the <br />City of Grand Island, and <br />WHEREAS, Henry Fuss and Ruth Fuss, husband and wife, have con- <br />sented to provide an easement, or right -of -way, on which to con- <br />struct such sanitary sewer main. <br />NOW, THEREFORE, in consideration of the sum of One Dollar ($1.00) <br />in hand paid by the City of Grand Island to the undersigned grantors, <br />receipt whereof is hereby acknowledged, and of the covenants and <br />agreements hereinafter set forth, the said Henry Fuss and Ruth Fuss, <br />husband and wife, do hereby grant and convey unto the City of Grand <br />Island, a municipal corporation, in Hall County, Nebraska, a perpet- <br />ual easement over, along and across a certain strip of land Sixteen <br />(16) feet in width and One Hundred Fifty-two (152) feet in length <br />in a part of Lot "H" Joehnck's Subdivision in the Southeast Quarter <br />(SE4) of Section Fifteen (15), Township Eleven (11) North, Range <br />Nine (9) West of the 6th P.M., Hall County, Nebraska, more particular- <br />ly described as follows: <br />Beginning at a point on the easterly line of Walker's <br />Subdivision, being a part of Lot "H in Joehnck's Sub- <br />division, One Hundred Thirty -three and Six Tenths <br />(133.6) feet southeasterly of the northeasterly corner <br />of Lot One (1) in Walker's Subdivision; running thence <br />northeasterly parallel to and One Hundred Sixty -six <br />and Six Tenths (166.6) feet distant from the northerly <br />line of said Lot "H" in Joehnck's Subdivision for a <br />distance of One Hundred Fifty-two (152) feet; running <br />thence southeasterly parallel to the easterl line of <br />said Walker's Subdivision for a distance of ixteen <br />(16) feet; running thence southeasterly parallel to <br />the northerly line of said Lot "H" for a distance of <br />One Hundred Fifty -two (152) feet to the easterly line <br />of said Walker's Subdivision; running thence north- <br />westerly on the easterly line of said Walker's Sub- <br />division for a distance of Sixteen (16) feet to the <br />point of beginning. <br />0 <br />
