<br />BAYARD H.`PAITE, JR., being first duly sworn, on his
<br />deposes '.and =:says,t hat .he is of legal age, that he is a
<br />r @si;lent;of"Grand Island, Hall County, Nebraska, and that he has
<br />"been ,such'`a °resident for more than fifty years last past.
<br />Affiant further states that he was well and personally
<br />acquainted with EMMA:KOHHLER, who received title to the above
<br />described property by the Vill and Final Decree in the Estate of
<br />Oscar Koehler, deceased, being Estate No. .2937, in the County
<br />Court of_Hall County, Nebraska, said Final Decree being dated
<br />November 29, 1939, and copy filed in Book 7, at Page 440, in the
<br />Office of the Register of Deeds, Hall County, Nebraska, and that
<br />he was.the attorney for said estate and for the said Emma Koehler,
<br />who wa$ the executrix therein of the estate of her husband, the
<br />said Oscar Koehler.
<br />Affiant further states that he was well and personally
<br />acquainted with EMMA D. KOEHLER, who was the grantor who deeded
<br />saio,.above property, as a widow, in a certain Warranty Deed that
<br />was 4ated` and acknowledged on May 23, 1944, filed on July 17,
<br />1946, and recorded in Book 91, at Page 137, in the Deed Records,
<br />in the Office of the Register of Deeds, Hall County, Nebraska,
<br />that when the said Emma D. Koehler later passed away on November
<br />24, 1949, he was one'of the attorneys for her estate in the County
<br />Court of Hall County, Nebraska, being Estate No. 4138, which estate
<br />was probated under the name of Emma Dekla Koehler, deceased.
<br />Affiant further states that he knows positively of his
<br />own knowledge that EMMA KOEHLER, EMMA D KOEHLER, and EMMA'DEKLA
<br />KOEHL£R, was one and the same person, notwithstanding the dis-
<br />crepaucy in names.
<br />Further, affiant sayeth not.
