provided that it shall replace any structures or improvements <br />removed from such premises with other structures or improvements <br />of substantially the same value, provided, however, that the <br />Purchaser shall/not and will not suffer or permit any mechanics <br />lien or other lien to attach to or be against or upon the property <br />aforesaid which shall or may be superior to the rights of the <br />Vendors. <br />It is understood by the parties hereto that this contract <br />doe,*ot cover any personal property now located in, on or about <br />the premises including office fixtures, tools, merchandise and <br />any and all filling station equipment which may be located on the <br />property. <br />It is understood and agreed that all payments on this contract <br />except the payment made at the time of the signing thereof, shall <br />be made to the Vendors through the escrow agent, The First <br />National Bank of Grand Island, Nebraska, and that such payment <br />shall be endorsed upon the contract by such escrow agent. The <br />Vendors agree that the escrow agent may deduct from each payment <br />made to it the amount of its fees and expenses in connection with <br />this matter and that it may deduct from the final payment made <br />hereunder, in adaition to such expenses, the cost of extending the <br />abstract of title and furnishing federal documentary stamps for <br />such deed. It shall not be the duty or obligation of the escrow <br />agent to enforce any of the terms of this contract but only to <br />take, receive, receipt for and deliver to the parties entitled <br />thereto the papers delivered to it, and to take, receive, receipt <br />for, and disburse the monies paid to it to the persons entitled <br />thereto under the terms of this contract and agreement. <br />It is further understood and agreed by and between the parties <br />hereto that if the Purchaser fails, refuses or neglects to pay any <br />of the payments or interest as herein provided for a period of <br />thirty days, time being of the essence of this contract, or fail <br />or neglect to pay any taxes or assessments before the same become <br />delinquent, or fail to keep the buildings or improvements on such <br />
