ORDINANCE NO. 3540
<br />AN ORDINANCE approving the subdivision into building lots
<br />and public streets of a part of the Northwest Quarter of the South-
<br />west Quartery (NW4SW) * of Section Twenty One (21), Township Eleven
<br />(11) North, Range Nine (9) West of the 6th P.M., in Hall County,
<br />Nebraska, to be known as "BRACHIS FIRST SUBDIVISION "; approving and
<br />accepting the plat of such subdivision, and the protective coven-
<br />ants, restrictions and conditions ppertaining to the lots in such
<br />subdivision, pursuant to Sections 16 -901 to 16 -904, Revised Statutes
<br />of Nebraska 1943, 1959 Cumulative Supplement, and Ordinance No.
<br />3442 of the City of Grand Island, Nebraska.
<br />WHEREAS, Matthew F. Brach and Josephine L. Brach, husband
<br />and wife; Sylvan T. Lepouce and Vivian G. Lepouce, husband and
<br />wife; and Willard L. Wilson and Lucille G. Wilson, husband and
<br />wife, have requested the approval by the City Council of the
<br />City of Grand Island, Nebraska, of the subdividing and platting
<br />into building lots and streets of a part of the NWSW/4 of Sec.
<br />21, T 11 N, R 9 W, of the 6th P.M. to be known and designated
<br />as "BRACHtS FIRST SUBDIVISION" and have submitted therewith,
<br />as required by such Ordinance No. 3442 a final plat, as approved
<br />by the City Planning Commission of such City of Grand Island,
<br />together with agreements for protective covenants, restrictions
<br />and conditions, as shall apply to the lots in such subdivision;
<br />and,
<br />WHEREAS, the City Council of the City of Grand Island having
<br />examined such final plat and agreements for protective covenants,
<br />restrictions and conditions to run with the lots, and the dedication
<br />of public streets and the grant of easement for public service
<br />utilities, finds that the provisions of such Ordinance No. 3442 have
<br />been complied with, and such subdivision should be permitted,
<br />NOW THEREFORE, be it ordained by the mayor and city council
<br />of the City of Grand Island, Nebraska, that:
<br />Section 1. The plat and dedication of such "BRACHtS FIRST
<br />SUBDIVISION" be, and hereby is, approved and accepted and such
<br />subdivision permitted.
<br />Section 2. The agreements for protective covenants, re-
<br />strictions, and conditions to run with the lots, be, and are
<br />hereby, approved and accepted.
<br />Section 3. There be endorsed upon the original plat
<br />and dedication of such subdivision =approved and accepted by
<br />the CITY COUNCIL of the City of Grand Island, Nebraskat to be
<br />dated and signed by the Mayor and City Clerk.
<br />Section 4. Such plat and dedication and agreements for
<br />protective covenants, restrictions and conditions to run with the
<br />lots, are hereby approved for filing in the office of the Register
<br />of Deeds of Hall County, Nebraska.
<br />Section 5. This ordinance shall be in force and take ef-
<br />fect from and after its passage, approval and publication as pro-
<br />vided by law.
