STATE OF NEBRASKA ) <br />) ss. A F F I D A V I T <br />COUNTY OF HALL ) <br />I, James B. Beltzer, being first duly sworn, depose and <br />say that I was Secretary of the Home Federal Savings and Loan <br />Association on July 1st, 1948, until the year 1959, and also <br />for the Grand Island Safe Deposit Company, and for the two <br />said companies had charge of the successive interest of the <br />two said companies in the following described property, to -wit: <br />Lot Three (3) and the Easterly Three and Eight Tenths <br />B.8) feet of Lot Four (4), all in Block Twenty -one <br />1) Fair View Park Addition to the City of Grand <br />Island, Hall County, Nebraska; <br />from about the 1st of January, 1948, when the loan on the two <br />said properties became delinquent, until the present time. <br />Affiant deposes and says that he knows of his own knowledge <br />that on September 13, 1948, neither George C. Garrelts or his <br />wife were occupying said premises or any part thereof, and that <br />it was not the homestead of either one or the other, cr both <br />of them; that the said Iola L. Garrelts had accepted the pro- <br />visions made for her in the divorce decree and had delivered <br />possession of the property to her husband, George C. Garrelts, <br />on or before said date of September 13, 1948; that the said <br />George C. Garrelts was in possession of the premises on <br />September 13th, 1948, as the owner but not as an occupant or <br />tenant thereof. That when the execution sale was confirmed on <br />October 29th, 1948, the said George C. Garrelts had legal <br />title to said premises and had possession thereof but not as <br />tenant or occupant thereof. That he immediately surrendered <br />possession of said premises to Amalie Garrelts, and that she <br />was in sole and exclusive possession of said premises upon <br />confirmation of said sale, except for tenants who paid rent, <br />and that at that time neither the said George C. Garrelts or <br />Iola L. Garrelts were occupying said premises or any part <br />thereof. <br />Affiant further deposes and says that the said Amalie <br />Garrelts sold and conveyed said premises to The Grand Island <br />Safe Deposit Company by Warranty Deed dated January 31, 1949 <br />and that at that time she was in sole possession of said pre- <br />mises, except for the rights of occupying tenants holding under <br />her, and that neither the said George C. Garrelts or I: -la L. <br />Garrelts were in possession of any cart of said premises, but <br />had abandoned any rights therein. <br />Affiant further deposes and says that on said date of <br />January 31st, 1949, the said The Grand Island Safe Deposit <br />Company entered into possession of said premises and since said <br />date has been in sole and exclusive and absolute possession of <br />said premises, claiming to be the owner thereof, and that at no <br />time since said date has either George C.
