STATE OF NEBRASKA ) ) ss. A F F I D A V I T COUNTY OF HALL ) I, James B. Beltzer, being first duly sworn, depose and say that I was Secretary of the Home Federal Savings and Loan Association on July 1st, 1948, until the year 1959, and also for the Grand Island Safe Deposit Company, and for the two said companies had charge of the successive interest of the two said companies in the following described property, to -wit: Lot Three (3) and the Easterly Three and Eight Tenths B.8) feet of Lot Four (4), all in Block Twenty -one 1) Fair View Park Addition to the City of Grand Island, Hall County, Nebraska; from about the 1st of January, 1948, when the loan on the two said properties became delinquent, until the present time. Affiant deposes and says that he knows of his own knowledge that on September 13, 1948, neither George C. Garrelts or his wife were occupying said premises or any part thereof, and that it was not the homestead of either one or the other, cr both of them; that the said Iola L. Garrelts had accepted the pro- visions made for her in the divorce decree and had delivered possession of the property to her husband, George C. Garrelts, on or before said date of September 13, 1948; that the said George C. Garrelts was in possession of the premises on September 13th, 1948, as the owner but not as an occupant or tenant thereof. That when the execution sale was confirmed on October 29th, 1948, the said George C. Garrelts had legal title to said premises and had possession thereof but not as tenant or occupant thereof. That he immediately surrendered possession of said premises to Amalie Garrelts, and that she was in sole and exclusive possession of said premises upon confirmation of said sale, except for tenants who paid rent, and that at that time neither the said George C. Garrelts or Iola L. Garrelts were occupying said premises or any part thereof. Affiant further deposes and says that the said Amalie Garrelts sold and conveyed said premises to The Grand Island Safe Deposit Company by Warranty Deed dated January 31, 1949 and that at that time she was in sole possession of said pre- mises, except for the rights of occupying tenants holding under her, and that neither the said George C. Garrelts or I: -la L. Garrelts were in possession of any cart of said premises, but had abandoned any rights therein. Affiant further deposes and says that on said date of January 31st, 1949, the said The Grand Island Safe Deposit Company entered into possession of said premises and since said date has been in sole and exclusive and absolute possession of said premises, claiming to be the owner thereof, and that at no time since said date has either George C. Garrelts or Iola L.
