ORDINANCE NO. 353
<br />An Ordinance granting the approval of the City Council of the
<br />City of Grand Island, Nebraska, to the subdivision designated'"Parm-
<br />ington Second Subdivision", same being contained upon a portion of
<br />the Southeast Quarter of the Southwest Quarter (SE /SW %) of Section
<br />Twenty -one (21), Township Eleven (11) North, Range Nine (9), West of
<br />the 6th P.M., Hall County, Nebraska, in accordance with Section 16
<br />902, Compiled Statutes of Nebraska, 1957; approving the plat of said
<br />subdivision and approving the protective covenants and restrictions
<br />pertaining to the lots, tracts and parcels of land in said subdivision,
<br />and all proceedings had and done in connection therewith.
<br />WHEREAS, Harvey C. Anderson and Anna M. Anderson, his wife, and
<br />Gustav W. Graupner and Joanne K. Graupner, his wife, have requested
<br />the approval of the City of Grand Island, Nebraska of the subdivision
<br />and platting of a subdivision to be known and designated as "Farming-
<br />ton Second Subdivision ", and have submitted therewith a plat showing
<br />the lots comprising said subdivision, together with the streets and
<br />roads, easements and rights -of -way for utilities; and
<br />WHEREAS, said Harvey C. Anderson and Anna M. Anderson, his wife,
<br />and Gustav W. Graupner, and Joanne K. Graupner, his wife, have further
<br />submitted to said City certain protective covenants and restrictions,
<br />which are to run with the title of the lots, tracts and parcels of
<br />land in said subdivision, and shall be binding upon all successors
<br />in title thereto; and
<br />WHEREAS, the City Council has examined said application, plat
<br />and protective covenants and restrictions, and has found that the
<br />same should in all respects be approved;
<br />NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
<br />CITY OF GRAND ISLAND, NEBRASKA:
<br />Section 1. That the application of the said Harvey C. Anderson
<br />and Anna M. Anderson, his wife, and Gustav W. Graupner and Joanne
<br />K. Graupner, his wife, for approval of said "Farmington Second Sub-
<br />division be and the same is hereby granted; that the plat of said
<br />subdivision, laying out said land into lots, streets, and easements
<br />for public utilities and public ways, be, and the same is hereby in
<br />all respects approved.
<br />Section 2. That the protective covenants and restrictions now
<br />on file in the office of the City Clerk which shall run with the
<br />title to the lots, tracts and parcels of land in said T armington
<br />Second Subdivision" be, and the same are hereb y a r
<br />accepted, and that the approval of the plat ofsaidsubdivision and
<br />of the covenants and restrictions be endorsed upon said plat and
<br />signed by the Mayor and the City Clerk, and that the seal of the
<br />City of Grand Island be thereunto affixed.
<br />Section 3. That the plat of said Farmington Second Subdivision
<br />and said protective covenants and restrictions be, and the same are
<br />hereby approved for filing in the office of the Register of Deeds of
<br />Hall County, Nebraska, as by law provided.
<br />Section 4. This ordinance shall be in force and take effect
<br />from and after its passage, approval and publication as provided by
<br />law.
<br />Passed and approved by a majority vote of all of the members of
