AGREEMENT FOR PROTECTIVE COVENANTS, RESTRICTIONS AND
<br />CONDITIONS FOR '"FARMINGTON SECOND SUBDIVISION"
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />WHEREAS, Harvey C. Anderson and -Anna M. Anderson, his
<br />wife,,and Gustav W. Graupner and Joanne K. Graupner, husband
<br />and wife, are the owners of all lots in "Farmington Second
<br />Subdivision ", an addition contained upon a ortion of the
<br />Southeast Quarter of the Southwest Quarter NE %SW %) of Section
<br />Twenty -one (21), Township Eleven (11) North, Range Nine (9),
<br />West of the 6th P. M. in Hall County., Nebraska, all a5 more
<br />specifically described in the plat of said Subdivision as the
<br />same is recorded in the Office of the Register of Deeds of Hall
<br />County, Nebraska; and
<br />WHEREAS, it is the desire of the aforesaid owners of said
<br />Subdivision to improve said "Farmington Second Subdivision"
<br />by encouraging the sale of lots and the construction of modern
<br />and desirable dwelling houses;,_
<br />NOW, THEREFORE, in consideration thereof, and of the
<br />mutual benefits to be derived by the owners of said Subdivision,
<br />and any purchaser or purchasers, their heirs, administrators,
<br />executors and asiggns, the owners stipulate and agree that
<br />any and all lots in said Subdivision sold, transferred and
<br />conveyed, shall be and are subject to the following protec-
<br />tive covenants, restrictions and conditions, all of which
<br />shall run with the land, as follows:
<br />(1) All lots in the Subdivision shall be known and de-
<br />scribed as residential lots. No apartment house, duplex, or
<br />triplex shall be built on any lot, nor shall any basement
<br />house be built on any lot. No structure shall be erected,
<br />altered, placed or permitted to remain on any lot other than
<br />one detached dwelling and a private garage for not more than
<br />three cars, and other secondary buildings incidental to the
<br />residential use of the plot. No dwelling shall be erected
<br />for occupancy for more than one family, nor shall.any dwell-
<br />ing be used for occupancy of more than one family. No
<br />commercial or business entereprise shall be conducted or
<br />operated in said Subdivision,
<br />(2) All frame buildings other than the main structure
<br />shall have the same quality of outside wall finish and roof as
<br />that approved for the residence. No such building can be
<br />made of unsightly materials, or.boxes.or.similar lumber.
<br />(3) All buildings shall be placed fifty (50) feet back
<br />from the front lot line of any lot, and all lots, including
<br />corner lots, shall be considered ,to run east and west, ex-
<br />cept Lots Three (3), Four (4), Five (5)' and Six (6) of Block
<br />One (1), which shall be considered to run north and south;
<br />frontage of lots shall be considered as that portion abutting
<br />upon north - south streets except that as to Lots Three (3)
<br />and Four (4) of Block One (1) frontage shall be that portion
<br />abutting on Stolley Park Road ard as to Lots Five (5) and
<br />Six (6) of Block Dme_(1), frontage,shall be that portion
<br />abutting on SPRUCE ROAD 912, Any building permitted
<br />upon any lot shall e at east seventeen and one -half (173/2)
