STATE OF- ss: AFFIDAVIT
<br />COUNTY OF HALL )
<br />B. J. CUNNINGHAM, being first duly sworn on oath,
<br />deposes and states that he is a resident of Grand Island, Hall
<br />County, Nebraska, and has been engaged in the practice of law
<br />in said County for fifty years; that affiant was well and per-
<br />sonally acquainted with Maria Hameloth, the grantor of a warranty
<br />deed dated February 1, 1930 and recorded in Book 73 at Page 154
<br />of the Deed Records of Hall County, Nebraska, in which instrument
<br />said grantor reserved a life estate; that affiant knows of his
<br />own personal knowledge that Maria Hameloth died at Grand Island,
<br />Nebraska, on October 14, 1950, and was buried on the 18th day of
<br />October, 1950 in the Grand Island Cemetary at Grand Island, Nebraska.
<br />Affiant further states that he was well and personally
<br />acquainted with Johann Harry Hameloth, grantee of a warranty deed
<br />dated February 1, 1930 and recorded in Book 73 at Page 154 of the
<br />Deed Records of Hall County, Nebraska, and with Harry Hameloth,
<br />whose estate was administered in the County Court of Hall County,
<br />Nebraska, Case No. 4204, and that the said Johann Harry Hameloth
<br />and Harry Hameloth were one and the same person despite the des -
<br />crepancy in names.
<br />Affiant further states that he prepared a quit claim
<br />deed from Gordon H. Hameloth and Etta Jane Hameloth, husband and
<br />wife, J. Harold Hameloth and P. Jean Hameloth, husband and wife,
<br />and Wanda Jean Spencer and John Spencer, wife and husband, to
<br />Emma Hameloth, dated August 2, 1954 and filed September 7, 1955,
<br />in Book 115 at Page 231 of the Deed Records of Hall County,
<br />Nebraska, and that affiant was present when said deed was signed
<br />and acknowledged and delivered by the grantors to the grantee on
<br />August 2, 1954.
<br />Affiant further states that he is personally acquainted
<br />with J. Harold Hameloth, one of the heirs -at -law of Harry Hameloth,
<br />as set forth in the Final Decree in the matter of the estate of
<br />Harry Hameloth and who is also one of the grantors of a quit claim
<br />deed dated August 2, 1954 and recorded in Book 115 at Page 231
<br />of the Deed Records of Hall County, Nebraska. Affiant further
<br />states that the full name of the said J. Harold Hameloth is John
<br />Harold Hameloth but that he has always used the name of J. Harold
<br />Hameloth in business transactions; that affiant knows that the
<br />said J. Harold Hameloth above named and John Harold Hameloth are
<br />one and the same person.
<br />Affiant further states that he is personally acquainted
<br />with P. Jean Hameloth, wife of J. Harold Hameloth, and that her full
<br />name is Phyllis Jean Hameloth and that the said P. Jean Hameloth and
<br />Phyllis Jean Hameloth are one and the same person.
