LEASE AND CONTRACT FOR REMOVAL OF <br />SAND, GRAVEL, DIRT, AND COBBLESTONE <br />This agreement is entered into between Silda Stelk, a widow, <br />Evelyn Diekman, Dorothy Sievers, Elmer D. Stelk, and Elaine Collier, <br />hereinafter known as the OWNERS, and Machan and Stelk, a partner- <br />ship organized under the Laws of the State of Nebraska, hereinafter <br />known as PARTNERS. <br />WITNESSETH: <br />1. In consideration of the premises and the agreements herein- <br />after set forth the OWNERS herewith lease to the PARTNERS for a <br />period of ten years from the date hereof the following described <br />real property. <br />The Southwest Quarter of the Southwest Quarter <br />(SW4SW4), of Section Fourteen (14), Township <br />Eleven (11), North, Range Nine (9), West of <br />the 6th P. M, in Hall County, Nebraska, except <br />the railroad track right -of -way. <br />The PARTNERS shall have the right to remove therefrom dirt, gravel, <br />sand, and cobblestone and to sell and dispose of the same in open <br />market. <br />2. The PARTNERS shall pay to the OWNERS for this lease and <br />removal rights for the dirt, sand, gravel, and cobblestone removed <br />and sold, at the rate as follows: <br />a. 5¢ per yard for fill sand <br />b. 5¢ per yard for salvage gravel <br />c. $1.00 per 5 cubic yard load of black dirt <br />d. $1.00 per 5 cubic yard load of cobblestone <br />The further consideration shall be that the PARTNERS agree to <br />grade and gravel the driveway and park area adjacent to the dwelling <br />house located on the Southwest Quarter of the Southwest Quarter of <br />the Section the subject of this Lease and Contract. <br />3. The PARTNERS agree to maintain records which are to be open <br />to inspection by the trustees of the OWNERS hereinafter named,on any <br />business day. The PARTNERS are to also furnish to the trustees for <br />the OWNERS on the first of each month a full record of all business <br />conducted and all sales made. The PARTNERS further agree to make <br />payments to the OWNERS on the first of each month as per the schedule <br />above on all monies received from the sale of the dirt, sand, gravel, <br />
