STATE OF NEBRASKA ) <br />SS: <br />COUNTY OF HALL ) <br />AFFIDAVIT <br />William F. Opp, Jr.,being first duly sworn, upon oath deposes <br />and says: <br />1. That he is of legal age and a resident of Hall County, <br />Nebraska, and that Marie Emma Opp was the daughter of Claus H. <br />Ewoldt and was his mother. <br />2. That his mother, Marie Emma Opp, died before Claus H. <br />Ewoldt and that she left as her sole and only heirs at law <br />William F. Opp, her husband, Elizabeth Opp Miller, Erhard Opp, <br />Frank Opp and William F. Opp, Jr., the affiant herein. <br />3. That the final decree in the matter of the estate of <br />Claus H. Ewoldt, Deceased, filed on March 18, 1918, states that <br />Marie Emma Opp was deceased, and that she left as surviving her <br />the following named children, Elizabeth Opp, Erhard Opp, Frank <br />Opp and William Opp, and that irrespective of the fact that the <br />name JR. does not appear after the name of William Opp and <br />irrespective of the fact that such name does not include the <br />middle initial of "F. ", the William Opp mentioned in such decree <br />and the affiant herein, William F. Opp, Jr., are one and the same <br />person. <br />4. That the brother of the affiant, Erhard Opp, departed <br />this life in 1937 and that he was a single man when he died and <br />had never been married, and that he left as his sole and only <br />heirs at law his father, William F. Opp, his sister, Elizabeth <br />Opp, his brother, Frank Opp and the affiant herein; that he did not <br />own any real property and that no application was ever made to <br />probate his estate; that the affiant knows of his own personal <br />knowledge that the father of Erhard Opp received the bequest of <br />$25.0.00 due Erhard Opp, Deceased, and receipted for the same. <br />5. That the affiant received the bequest in full due him <br />pursuant to the Last Will and Testament of Claus H. Ewoldt, <br />and he knows of his own personal knowledge that Elizabeth Opp <br />Miller and Frank Opp also received their bequests in full. <br />Further Affiant Saith Not. <br />Dated this � day of March, 1960. <br />William- William-P.
