other public place by the Second Party or anyone acting for it in its behalf, which <br />shall place a cloud on the legal title of the First Parties to this Contract; and in <br />event Second Party shall not comply with this paragraph, it shall pay to First <br />Parties all expenses, including court costs and solicitor's fees, incurred by them <br />in any proceeding to remove such instrument, statement, paper, or affidavit from <br />record which places a cloud on the title of the First Parties to the property, or <br />without prejudice to any other right of the First Parties to declare this Contract <br />ended and thereafter null and void, which latter right is hereby expressly given to <br />and reserved by the First Parties. <br />XI. <br />In case of the failure of the Second Party to .make any of the payments, or <br />any part thereof, or perform any of the covenants hereof on its part hereby .made <br />and entered into, this Contract shall, at the option of the First Parties, be forfeited <br />and determined, and the Second Party shall forfeit all payments made by it on this <br />Contract, and such payments shall be retained by the First Parties in full satisfac- <br />tion and as liquidated damages by them sustained, and in such event, the First <br />Parties shall have the right to re -enter and take possession of the premises afore- <br />said. An exception to the foregoing will be made by First Parties in the event the <br />failure to perform is due to circumstances beyond the control of Second Party, or <br />of a bona fide error by Second Party, in which event a grace period of thirty (30) <br />days will be granted to Second Party. It is specifically understood, however, that <br />such grace period does not extend to the performance of the terms of this Contract <br />in any except the above circumstances. <br />XII. <br />In the event this Contract or Agreement shall be declared null and void by <br />the First Parties on account of any default, b1'each, or violation by the Second <br />Party in any of the provisions hereof, the same shall become and be null and void <br />and be so conclusively determined by the filing by the First Parties, of a written <br />declaration of forfeiture hereof, in the Office of the Register of Deeds of Hall <br />County, Nebraska. <br />- 5 - <br />
