City of Grand Island, Nebraska, -and in that case the right of
<br />the Second Parties and of the Third Party and of the successors
<br />and assigns of the Second Parties - and the Third Party to use the
<br />passageways herein provided shall terminate.
<br />3. The First Parties, the Second Parties, the Third
<br />Party, and their and its respective -customers, invitees, employees,
<br />and agents and the successors and assigns of the First Parties,
<br />the second Parties, and the respective survivors thereof, and
<br />the Third Party, shall have the right to use :concurrently, but
<br />not exclusively, the passageways hereinafter *described, and the
<br />First Parties reserve the right to put into effect,,in writing,
<br />rules reasonably necessary for and conducive to the'-harmonious
<br />use of such passageways concurrently by permitted motor vehicles
<br />and persons.
<br />4. The First Parties hereby give, grant and convey to
<br />the Second Parties and the Third Party, and the successors and
<br />assigns of the Second Parties and the Third Party and the cus-
<br />tomers, invitees, employees, and agents of the.Second Parties
<br />and the Third Party, the right at all times to pass -'over and
<br />the .. said - described passageways from the Southend
<br />of Eddy Street of the City of Grand Island to Stolley Park Road
<br />along the South Line of sucti`Southeast Quarter .(SE'/4) of said
<br />Section Twenty -One (21), such passageways being more particularly
<br />described in the instrument recorded in Book 7, Page 291 of
<br />Miscellaneous records in the office of the Register of Deeds
<br />of Hall County, Nebraska.
<br />5. Each of the Parties hereto agrees with. each and
<br />all of the other parties hereto and their successors and assigns,
<br />that he, she, they or it will not block such passageways or any
<br />part thereof and will not permit any of his, her, their or its
<br />customers, employees, invitees, or any person or persons coming
<br />to or leaving his, her or its place of business to block in
<br />,whole or in part such passageways or any part thereof.
<br />6. The Second Parties and the Third Party covenant.
<br />and agree respectively that they and his, her and :its agents,
<br />employees, successors and assigns, shall conform to',all reasan-
<br />able rules and regulations.put into effect by the First Parties
<br />pertaining to the use of such passageways.
<br />7. The First Parties are not obligated nor bound to
<br />maintain such passageways and are not obligated to, remove snow
<br />or ice therefrom.
<br />8. The Second Parties and the Third Party, for himself,:
<br />herself and itself and forlhis, her, their and its successors
<br />and assigns to protect and save the First Parties "harmless.from
<br />any and all claims for injury to =any'- property a person or
<br />persons resulting from an accident, resulting from the use of _
<br />such passageways by any authorized - -- .person or vehicle-
<br />The First Parties stipulate that this agreement is entered- 'a
<br />into upon the understanding that the same- shall be for the.bene-
<br />fit of the mortgagee of the Second Parties as recorded in-Book
<br />_, Page /tts , and the mortgagee- of the Party in
<br />Book / / 9 , Page 3 v J- , of Mortgage Records in the office
<br />of the Register -of . Deeds of Hall _County, - Nebraskan -and as= signs of =
<br />mortgagees and. subsequent mortgageei- -af - either- such- Second Parties_ -
