NOW THEREFORE, in consideration of the premises, it is <br />agreed by and between the parties hereto that such "Temporary <br />Right -of -Way" shall be and hereby is amended to include the <br />Third Party and is further hereby amended,`modified and changed <br />so as to provide as follows: <br />1.-,The parties agree that nothing herein shall give, <br />or be construed to mean that, the public shall have-any right, <br />of "Public Use" of the passageways herein granted, or any part <br />thereof, or through and across the - same, it- being -the intention <br />to reserve unto the First Parties, Second Parties and the Third = <br />Party and their successors and assigns, as their - rights hereunder_ <br />may appear all and every control of the use of such passageways <br />by persons and motor vehicles.. <br />2. It is expressly agreed between the parties that the <br />First Parties reserve the option t-o hereafter provide the'Second <br />Parties and the Third Party and their respective successors and <br />assigns, by private grant or dedicaton to public use, with <br />a substitute passageway with not less than_thirty (30) feet width <br />and provide access to a public his-h:way or` public street in the <br />-1- <br />
