MUTUAL EASEMENTS <br />This Agreement made and entered into this 1st day of September, 1959, between <br />Eveline Gebhart, hereinafter referred to as First Party, and Edward C. Casford and <br />LaVetta A. Casford, each in his and her 'own right and as spouse of the other, herein- <br />after referred to as Second Parties, as follows: <br />Whereas, the parties hereto are the owners of the following- described real <br />property: <br />Commencing at a point 40 Feet Westerly and 40 Feet Northerly <br />from the Southeasterly Corner of Lot Thirteen (13) of the County Sub- <br />division of the South Half of the Southeast Quarter (Sz, SE-1 of Section <br />Sixteen (16) in Township Eleven (11), North, Range Nine (9) West of the <br />6th P. M. , the real place of beginning, running thence Northerly parallel <br />with the Easterly Line of Said Lot Thirteen (13), for a distance of One <br />Hundred Thirty -two (132) Feet, thence turning a right angle and running <br />in a Westerly direction for a distance of Sixty -four and Three - fourths <br />(64 -3/4) Feet, thence turning a right angle and running in a Southerly <br />direction, parallel with the Easterly Line of said Lot Thirteen (13), for <br />a distance of One Hundred Thirty -two (132) Feet, thence turning a right <br />angle and running in an Easterly direction, parallel with the Southerly <br />Line of said Lot Thirteen (13), for a distance of Sixty -four and Three - <br />fourths (64 -3/4) Feet to the place of beginning, excepting therefrom, <br />however, that part thereof conveyed to Central Power Company by <br />Warranty Deed recorded in Book 75, at Page 374, of the Deed Records <br />of Hall County, Nebraska, <br />the Second Parties being the owners of the Northerly Seventy -two (72) Feet of the above - <br />described real property, and the First Party being the owner of the remaining Southerly <br />part thereof, and the parties hereto desire to give, grant, bargain, and sell to the other <br />mutual easements over and across the real estate owned by them, for the installation and <br />repair of utilities that may cross either property, for the benefit or service of the other. <br />It is therefore agreed between the parties hereto that, in consideration of mutual <br />covenants, each of the parties hereto gives, grants, bargains, and sells to the other a <br />perpetual easement to enter upon either property for the installation or repair of any <br />utility that may cross either property for the service of the other, such utilities being <br />electric lights, gas, water, or sewer. <br />Each party hereto agrees that they will enter the property of the other only <br />when necessary to install or repair such utilities, and will restore the premises of <br />-1- <br />
