AGREEMENT FOR EASEMENT
<br />THIS AGREEMENT, made and entered into this 27�!day of
<br />March, 1958, by and between EVERETT S. IVIIETH and AUGUSTA C. MIETH,
<br />husband and wife, each in his or her own right and as spouse of the
<br />other, of Rural Route, Cairo, Hall County, Nebraska, hereinafter
<br />referred to as GRANTORS, and VERLE PJIETH, a widow, of
<br />..Ts /anW,
<br />Vie, Hall County, Nebraska, hereinafter referred to as GRANTEE,
<br />WITNESSETH:
<br />WI-IEREAS, about December, 1956, a pipe line was installed
<br />below the ground for the transpoitation of gas in, through and along
<br />the half section line, described as the northerly boundary line
<br />of the North Half of the Southwest Quarter (N-SW-4) of Section Four
<br />(4), in Township Eleven (11), North, Range Twelve (12), West- of
<br />the 6th P.M., in Hall County,Nebraska, which property is owned by
<br />the Grantors, said gas pipe line extending to the property owned
<br />by Grantee, adjoining the property of Grantors; and,
<br />WHEREAS, no right -of -way grant or easement has been made
<br />for this said gas pipe line, except the oral permission of the
<br />Granters, and the Grantee is esirous of having such oral agreement
<br />set down in writing; and,
<br />:Tri�,RuaS, Grantors and Grantee both use pact of said gas
<br />pipe line, to a point where the pipe line divides and separate meters
<br />have been installed, the Grantee, alone, using the remainder of the
<br />line;
<br />WO-Idt THEREFORE, in consideration of the mutual promises
<br />and covenants of all parties hereto, it is hereby mutually agreed
<br />by and between the parties hereto, as follows, to -wit:
<br />1. Grantors hereby grant, convey and confirm an easement
<br />and right -of -way across their above described property to the adjacent
<br />property of the Grantee for the transporation of gas in and throucj
<br />said pipe line, which is approximately a one and one - quarter inch
<br />pipe, and which is approximately two feet below the surface of the
<br />ground, and appurtenances thereto, together with the easement and
<br />right -of -way grant to make any necessary repairs and construction,
<br />and to maintain, renew, replace,,inspect and operate said gas pipe
<br />line in its present location and depth, but same shall be done at a
<br />minimum of damage, inconvenience or disruption in the use and enjoy-
<br />ment of said premises to Grantors, and Grantee shall be liable to
<br />the Grantors for all actual damages caused thereby.
