<br />location, construction and mainte-
<br />nance of :public service utilities
<br />thereon, intended to be dedicated
<br />for public use, and for the use
<br />of the purchasers or owners of lots
<br />fronting thereon or adjacent there-
<br />to, including the plan or system
<br />for the avenues and streets to be
<br />laid out within or across t1le same; �t

<br />WHEREAS, said Robert L. Kriz
<br />and James M. Davis, owners of
<br />said tract of land, and Mary Jean
<br />Kriz, wife of Robert L. 'Kriz, and;
<br />Joan W. Davis, wife of James M.
<br />Davis, have further' submitted to
<br />said City Council of the City of
<br />Grand Island, Nebraska certain
<br />Protective convenants, restrictions
<br />and conditions for "Kay -Dee Sub-
<br />division" which are to run with the
<br />title of the lots, tracts and parcels
<br />of land in said subdivision, and
<br />shall be binding upon the owners,
<br />their heirs, administrators, execu-
<br />tors, assigns, grantees and devisees

<br />WHEREAS, the City CouLncii of?

<br />braska, has found that the applica-
<br />tion plat; plan of subdivision,
<br />plan and system for the avenues
<br />and streets to be laid within or
<br />across the same, the easements
<br />for the location, construction and
<br />maintenance of :public service utili-
<br />ties, and ,the agreement for protec+
<br />Live ' covenants restrictions and
<br />conditions for "Kay -Dee Subdivi-
<br />sion" should in all respects be
<br />approved: NOW, THEREFORE,
<br />BE IT ORDAINED BY THE MAY-
<br />OR AND COUNCIL OF THE CITY
<br />OF GRAND ISLAND, NEBRASKA:
<br />Section 1. That the application
<br />of the said Robert L. Kriz and
<br />James M. Davis, owners of a tract
<br />of land in the Southwest Quarter
<br />of the Southwest Quarter (SWy4
<br />SWl/4), in Section Twenty-one (21),
<br />Township Eleven (ll) North,
<br />Range Nine (9), West of the '6th
<br />P. M., in Hall County, Nebraska,
<br />and of. Mary Jean Kriz, wife of
<br />said Robert L. Kriz,' and Joan W.
<br />Davis, wife of James M. Davis,
<br />for approvaa of the subdivision,
<br />p&d and layout 4 said tract of
<br />real property in building dots,
<br />streets, avenues, easements, and
<br />.protective covenants,.. restrictions
<br />and conditions, and other portions
<br />of said tract of real property in-
<br />tended to be dedicated' � public
<br />use,: or for the use- of the pur-
<br />�chasers or owners of lots fronting

<br />the City of Grand Island, Nebraska,
<br />for approval, which such agree=
<br />melt shall run with the title to
<br />the lots, tracts and parcels of land=
<br />in said 'Kay-Dee Subdivision- be,
<br />and the same are hereby approved`
<br />and accepted.
<br />Section 3. That the approval of
<br />the subdividing, platting and Jay

<br />known as "Kay -Dee. Subdivision",
<br />and designated as such, located in
<br />the Southwest Quarter of the South-
<br />west Quarter (SWY4SW1/4) in Sec-

<br />(9), West of the 6th P. M., in Half'
<br />aunty, - Nebraska, and of the

<br />doused upon said plat,' and upon
<br />said agreement for protective cov

<br />signed by the Mayor and the City
<br />Clerk, and that the seal of the City;.

<br />Section 4. That the plat of said

<br />nants, restrictions and conditions
