of said subdivision to establish connection with said sewer system <br />without delay, and thereafter to make use of the same to the exclusion <br />of all septic tanks and other private methods of handling sewerage. <br />(14) The owners of any and all lots of said subdivision, their <br />heirs, administrators, executors, assigns, grantees and devisees <br />acknowledge that under the provisions of Setion 16 -901, Revised Statutes <br />Supplement, of Nebraska, 1957, the City of Grand Island, Hall County, <br />Nebraska, is granted power and authority to extend and apply by ordi- <br />nare its zoning regulations, property use regulations, building <br />ordinances, electrical ordinances, and plumbing ordinances, to the <br />lots of the subdivision, and agree to be bound by all such lawful <br />ordinances pertaining to zoning regulations, property use regulations, <br />building ordinances, electrical ordinances, and plumbing ordinances, <br />which the City of Grand Island, Hall County, Nebraska, may or shall <br />by ordinance extend or apply to said subdivision. <br />(15) All construction and building shall be so performed that <br />it will comply with requirements of the holding codes and ordinances <br />of the City of Grand Island, Hall County, Nebraska. <br />(16) If any owner of any lot or his, her, or their heirs, or <br />assigns, shall violate or attempt to violate any of the covenants, <br />restrictions and conditions, that are hErein set forth, it shall be <br />lawful for any other pEr son or persons owning any real estate in <br />said addition to prosecute such proceedings at law or in equity <br />against the person or persons violating or attempting to violate any <br />such covenants, restrictions and conditions, and to preventl-im, her, <br />or them, or assigns, from so doing or to recover damages for such <br />violations. <br />(17) If any of the covenants, restrictions or conditions <br />herein set forth are violated and declared void by a court of competent <br />jurisdiction, the remaining covenants, restrictions and conditions <br />shall not be affected but shall stay and remain in full force and <br />effect. <br />(lg) This agreement and the faithful performance of the terms <br />thereof shall be binding upon the heirs, administrators, executors, <br />assigns, grantees and devisees of the parties to this contract, and <br />upon the purchaser or purchasers of any lot`or lots in said "Kay -Dee <br />Subdivision ". <br />IN WITNESS WHEREOF, we have hereunto set our hands this <br />day of �, 1959. <br />Robert <br />r° <br />Witnessed by: r can Kriz <br />-3 <br />�9� <br />
