AGREEMENT FOR PROTECTIVE COVENANTS, RESTRICTIONS AND CONDITIONS

<br />"KAY -DEE SUBDIVISION", LOCATED IN HALL COUNTY, NEBRASKA
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />WHEREAS, Robert L. Kriz and James M. Davis are the owners of
<br />all lots in "Kay -Dee Subdivision ", a subdivision in Hall County,
<br />Nebraska located upon a part of the Southwest Quarter of the Southwest
<br />Quarter- tSWOW, in Section Twenty -one (21), Township Eleven (11)
<br />North, Range Nine (9), West of the 6th P.M. in Hall County, Nebraska,
<br />all as more specifically described in the pat of said subdivision
<br />as the same is recorded in the office of the Register.o£ Deeds of
<br />Hall County, Nebraska; and
<br />WHEREAS, it is the desire of the aforesaid owners of said
<br />subdivision to improve said "Kay -Dee Subdidson" by encouraging the
<br />sale of lots and the construction of modern and desirable dwelling
<br />houses, and to insure the use -of the property for attractive resi-
<br />dential purposes only, to prevent nuisances, to prevent the impairment
<br />of the attractiveness of the property, to maintain the desired tone
<br />of the community, and thereby to secure to each site owner the full
<br />benefit and enjoyment of his home, with no greater restriction upon
<br />the free and undisturbed use of his site than is necessary to insure
<br />the same advantages to the other site owners; and
<br />WHEREAS, Mary Jean Kriz is the wife of Robert L. Kriz and
<br />Joan W. Davis is the wife of James M. Davis, owners of all of the
<br />lots in said "Kay -Dee Subdivision ":
<br />NOW, THEREFORE, in consideration thereof, and our mutual
<br />interest as owners of all of the real estate in said subdivision,
<br />and of the mutual benefits to be derived by the owners of said
<br />subdivision, and any purchaser or purchasers, their heirs, adminis-
<br />trators, executors and assigns, the owners and their spouses, for
<br />themselves, and their heirs, executors; administrators, and assigns,
<br />stipulate and agree that any and all lots in said subdivision sold,
<br />transferred and conveyed, shall be and are subject to.the following
<br />protective covenants, restrictions and conditions, all of which shall
<br />run with the land, as follows:
<br />(1) All lots in the subdivision shall be known and described
<br />as residential lots. No apartment house, duplex, or triplex, shall
<br />be built on any lot, nor shall any basement house be built on any
<br />lot. No structure shall be erected, altered, placed or permitted to
<br />remain on any'lot other than one detached dwelling, which may include
<br />a private garage, and other secondary buildings, including a prtate
<br />garage and swimming pool, incidental to the residential use of the plot.
<br />No dwelling shall be erected for occupancy of more than one family,
<br />nor shall any dwelling be used for occupancy of more than one family.
<br />No commercial or business enterprise shall be conducted or operated
<br />in said subdivision.
<br />(2) All frame buildings other than the frame structure shall
<br />have the same quality of outside wall finish and roof as that approved
<br />for the residence. No such building can be made of unsightly materials,
<br />or bodes or similar lumber.
<br />(3) All buildings shall be placed at least forty 140) feet
<br />back from the front lot line on lots except twenty -five (25) feet
<br />back from the front of lot line on Lots One (1), Two (2), and Three
