AGREEMENT FOR PROTECTIVE COVENANTS,
<br />RESTRICTIONS AND CONDITIONS FOR
<br />"KDTICKREHM THIRD ADDITION"
<br />•.. TO THE CITY OF GRAND ISLAND, NEBRASKA
<br />WHEREAS, Frieda Knickrehm, owner of all lots in "Knickrehm
<br />Third Addition" to the City of Grand Island, Nebraska, and,
<br />WHEREAS, it is the desire of the owner of said addition to
<br />improve said "Knickrehm Third Addition" by encouraging the sale
<br />of lots and the construction of modern houses;
<br />NOW, THEREFORE, in consideration thereof, and of the benefit to
<br />be derived by the owner of said addition and any purchaser or purch,�•
<br />asers, their heirs, administrators, executors and assigns, the owner
<br />in her own right stipulates and agrees that any and all lots in` said
<br />addition sold, transferred and conveyed, shall be and are subject to
<br />the following protective covenants, - restrictions and conditions, all
<br />of which run with the land as follows;
<br />(1) All lots in the addition shall be known and described as
<br />residential lots. No apartment house, duplex or triplex shall be
<br />built on any lot, no structure shall be erected, altered, placed or
<br />permitted to remain on any lot other than one detached single dwell-
<br />ing not to exceed two and one -half stories in he ir�ht and a private
<br />garage for not more than three cars, and other secondary buildings
<br />incidental to residential use of the plot.
<br />(2) All frame buildings other than the main structure shall
<br />have the same quality of outside wall finish and roof as that approved
<br />for residence. No such buildings can be made of unsightly materials,
<br />or boxes or similar lumber.
<br />(3) All buildings shall be placed at least thirty (30) feet
<br />from the front lot line of said lot and on corner lots all buildings
<br />shall be at least five (5) feet back from the side street line. Any
<br />detached garage or separate secondary structure shall be not less
<br />than sixty (60) feet back from the front lot line and on corner lots
<br />shall be not less than five (5) feet from side street line.
<br />(4) No building or dwelling house shall be moved into said
<br />addition and placed upon a lot; no trailer, tent, garage, shack,
<br />or other unsightly out - building shall be used as a dwelling at any
<br />time, nor shall any structure of a temporary character, nor any
<br />basement house be used as a residence at any time.
<br />(5) The ground floor area of the main structure exclusive of
<br />open porches and garages, shall not be less t:ian 850 square feet
<br />for one story or a one and half story structure, and shall not be
<br />less than 650 square feet for a two story structure.
<br />(6) All public sidewalks shall be curb sidewalks; the acceptance
<br />of a deed of conveyance by any purchaser or purchasers of any lot,
<br />lots, or fractions thereof, shall be and amount to and be construed
<br />as consent thereto and approval of such curb sidewalk.
<br />(7) No sod, earth, sand, gravel or trees shall be removed to
<br />the injury of the value of or appearance of any lot, and no used
<br />,,building, material, junk or rubbish, shall be left exposed on said
<br />lot except during actual building operations.
<br />(8) No.worn out or discarded automobiles, machinery or parts
<br />thereof shall be stored on any lot in the addition; no portion
<br />thereof shall be used for automobiles, junk piles, or storage of
<br />any kind of junk or waste materials.
