AGREEMENT FOR SALE OF REAL ESTATE
<br />THIS AGREEMENT entered into this A24 day of Naember, 1958,
<br />between E. R. MYERS and JUAN MYERS, husband and wife, of Hall County,
<br />Nebraska, hereinafter called "sellers ",and ARNOLD MEYER of Hall
<br />County, Nebraska, hereinafter called "purchaser ", WITNESSETH:
<br />The sellers agree to sell and the purchaser agrees to purchase
<br />certain premises situated in Hall County, Nebraska, and described as
<br />Lots Six (6) and Seven (7) of Bachman & Lester Subdivision in Section
<br />Twenty (20) and Fractional Section Nineteen (19), Township Eleven (11)
<br />North, Range Nine (9), West of the 6th P.M., Hall County, ,-Nebraska,
<br />and in accordance with the recorded plat on file in the office of the
<br />Register of Deeds of Hall County, Nebraska.
<br />Included in the sale and as a part of the premises are the
<br />heating units, electrical wiring and fixtures,and improvements and
<br />fixtures of a similar nature. Sellers reserve the right to remove
<br />all contents now in the building including a mill, merchandise and
<br />other personal property.
<br />Purchaser agrees to pay as consideration for said premises
<br />with improvements the sum of Thirty -five Thousand & No 1100 Dollars
<br />035,000.00) of which One Thousand & No /100 Dollars 01,000.00) has`..
<br />this date been paid to sellers, receipt whereof is hereby acknowledged,
<br />with the additional sum of Four Thousand & No /100 Dollars ($4,000.00)
<br />to be paid on January 2, 1959, making an aggregate of Five Thousand
<br />& No /100 Dollars ($5,000.W which represents the full initial down -
<br />payment. The balance of the purchase price of Thirty - Thousand & No /100
<br />Dollars ($30,000.00) shall draw interest at the rate of 42% per annum
<br />from January 1, 1959, payable annually on January 15 of each year, the
<br />first interest payment to be due January l5, 1960, and such interest
<br />to be computed on decreasing principal balances. In addition to the
<br />annual payment of interest the purchaser agrees to pay the sum of
<br />Five Thousand & No /100 Dollars ($5,000.00) on principal on January15,
<br />of each year, commencing January l5, 19 E0, with the last and final
<br />installment to be paid January 15, 1965. Upon payment of the last
<br />installment with accrued interest, a deed executed by sellers and
<br />placed in escrow as hereinafter provided shall be delivered to the pur-
<br />chaser. All payments of interest and principal commencing with the
<br />payment on principal due January 2, 1959, shall be paid to the escrow
<br />agent.
<br />Possession of said premises including improvments shall be
<br />delivered to purchaser on January 2, 1959, and upon payment of the
<br />amount stipulated to be paid on that date on the principal. The
<br />improvements shall be delivered in substantially the same condition
<br />in which they now are, reasonable use and wear thereon and damage by
<br />fire and other unavoidable casualty excepted.
<br />The buildings and improvements on the premises shall, until
<br />the full performance of this agreement, be kept insured in an amount
<br />at least equivalent to the unpaid principal balance due under this
<br />contract. The sellers /agree to maintain insurance in a company satis-
<br />factory to the purchaser until January 2, 1959, and, in case of loss,
<br />all sums recovered or recoverable on account of said insurance shallbe
<br />paid over or assigned on delivery of the deed to the purchaser, unless
<br />the premises shall previously have been restored to their former
<br />condition by the sellers. At the time possession is delivered to the
<br />purchaser, the requirements for maintenance of insurance by the sellers
<br />shall cease and thereafter such insurance shall be maintained on the
<br />premises by the purchaser and such policies shall contain a sufficient
<br />endorsement providing proceeds be payable -to the parties as their
<br />interest may appear. Purchaser agrees to take over all insurance on the
<br />premises and all policies of insurance shall be assigned to the purchaser
