} <br />or le <br />AGR VENT; <br />THIS .&GREG+, ENT, entered into this 15th.day of May, 1945, <br />by and between Anna Davis of Grand Island, Nebraska, party of the <br />first part and Neta J. Hubbard of Grand Island, Nebraska, party of <br />the second part. <br />WITNTSSETH, that the party of the first in consideration of <br />the sum of Six Thousand and no /100 Dollars ($6,000.00) has this day <br />bargained, and sold to the party of the second part the following <br />described property,to -wit: Lot "H" of Joehnek's Sub - Division, <br />located, on part of the Southeast quarter (SE- -) of Section <br />Fifteen x(15), Township Eleven (11), North, Range Nine (9) <br />=Vest of the 6th. P.P., in Hall County, Nebraska, saving and <br />excepting therefrom that part conveyed to Carl Joehnck by <br />i'larranty Deed recorded in Book 68 at Page 19 of Deed Records <br />of Hall County, Nebraska, <br />on the following terms and stipulations, to -wit: One Thousand <br />Dollars in hand paid reciept whereof is hereby acknolwedged, the <br />remaining Five Thousand dollars ($5,000.00), to be paid in manner <br />and form as follows: Fifty and no /100 Dollars , payable on the first <br />of each and every month beginning with June 1,1945, and continuing <br />until the full sum upaid shall have been paid, with interest on the <br />unpaid balances to be payable semi - annually at 4%, the party of the <br />second part to pay all taxes beginning with the year 1945, time to <br />be of essence in this contract; that on the failure of the party of <br />the. second part to make any payment due within 60 days after said <br />payment shall become then the party of the first /shall declare all <br />payments *wade on this contract to be forfeited as liquidated damages <br />and may proceed to foreclose at her option. <br />1,1MIERRAS, the party of the first part in anticipation of her✓ <br />death has signed and delivered a deed to the above described premises <br />to Neta J. Hubbard and Charles P. Davis, they being her only heirs, <br />It Is Further Agreed, that on the death of Anna Davis, an adjustment <br />as to the value of the above described property is to be made between <br />Neta J. Pibbard and Charles P. Davis, whom she 1mx$3mz xkz has deeded <br />the aforementioned property to, that is to say that the unpaid <br />balance of $5,000.00, at the time of the signing of this contract, <br />shall be credited with all payments made by the said Neta J. Hubbard, <br />and the remaining unpaid balance shall be the basis of settlement <br />
