" <br />�... <br />A G R E E M E N T <br />This agreement made and entered into this 30th day of September, <br />1952, by and between C. Freida Fries and Henry G. Fries, hereinafter <br />designated as parties of the first part, and Walter P. Lacey and Reva M. <br />Lacey, hereinafter designated as parties of the second part, WITNESSETH: <br />That the said parties of the first part agree to sell to the <br />parties of the second part, and the said parties-of the second part <br />agree to purchase of the parties of the first part, the following des- <br />cribed real estate situated in the City of Grand Island, County of Hall, <br />and State of Nebraska, to -wit: <br />Lots One Hundred Seventeen (11 and One Hundred Eighteen (118 <br />in Belmont, an Addition to the 21.12 of Grand Island, Nebraska. <br />The parties of the second part agree to pay to the parties of <br />the first part as full consideration for the above described premises, <br />the sum of Seventy Five Hundred & No /100 (7500.00) Dollars, as follows, <br />to -wit: One Thousand & No /100 (1000.00) Dollars, cash in hand paid, the <br />receipt of which is hereby acknowledged, and the balance of Sixty Five <br />Hundred & No /100 ($65oo.00) Dollars, with interest at the rate of 61. <br />payable at the rate of Fifty Five & No /100 (55.00) Dollars per month, <br />the first payment to be made on the 1st day of November, 1952, and Fifty <br />Five & No /100 ($55.00) Dollars on the lst of each succeeding month until <br />the full amount has been paid. <br />It is further agreed to by and between the parties hereto that the <br />Fifty Five & No /100 ($55.00) Dollar monthly payment will include the int- <br />erest and the loan. <br />It is further understood by and between the parties hereto that <br />the taxes and insurance on the property are to be paid by the parties <br />of the second part in addition to their monthly payments in the amount <br />of Fifty Five & No /100 ($55.00) Dollars. <br />It is further agreed to by and between the parties hereto that <br />the parties of the first part will pay 10/12 of the taxes for 1952, and <br />that the parties of the second part will pay the 2/12 of the taxes for <br />1952. <br />It is further agreed to by and between the parties hereto that the <br />parties of the second part will insure the buildings for not less than <br />Seventy Five Hundred & No /100 ($7500.00) Dollars, a copy of the insurance <br />policy to be attached to this contract and assigned to C. Freida Fries <br />and Henry G. Fries. Parties of the first part have made and executed <br />a warranty deed which accompanies this instrument and will furnish an <br />abstract showing a merchantable title to said land. <br />The parties of the first part further agree to deliver free and <br />clear of all encumbrances, the within property upon the full payment <br />of this contract. <br />It is further agreed to by and between the parties hereto that <br />the parties of the second part reserve the right to pay off the entire <br />balance at any time during the existence of this contract. <br />Possession to be given immediately upon the signing of this con- <br />tract. <br />In case the said parties of the second part shall fail for a <br />period of three (3) months to pay the montly installments, then and in <br />that event, all payments shall be forfeited to the parties of the first <br />part as full liquidated damages, and to deliver up possession of the <br />property peaceably and without cost to the parties of the first part. <br />
