REINSTATaIENT AGREE4INT <br />KNOW ALL MEN BY THESE PRESENTS, that <br />This agreement dated this 8th day of July,1958 by and between <br />Nitzel and Company, a corporation, parties of the first part and THE PRUDENTIAL <br />INSURANCE CnG'TPANY OF AMERICA, a New Jersey corporation having its Home Office <br />and principal place of business in the City of Newark, State of New Jersey, <br />party of the second part; <br />WITNESSETH: <br />WHEREAS, the said parties of the first part had assumed and agreed to <br />pay a certain note dated January 25, 1952 in the original principal sum of <br />:8,550.00, payable to THE PRUDENTIAL INSURANCE CC- PIPANY OF AMERICA, which <br />note was executed by Phil Pain-,er and Margaret Painter., husband and wife, <br />which note was secured by an even date mortgage covering land described as <br />follows: <br />The South Half of the West Half (S3�j- <br />�) of the East Two - <br />Hundred- Seventy (270) Feet of Lot Thirteen (13) in Vantine's <br />Subdivision, according to the recorded plat thereof, located <br />on part of the Northwest Quarter (m%T ) of Section Twenty -two <br />(22), Township Eleven (11) North, Range Nine (9) West of the <br />Sixth Principal Meridian, in Hall County, Nebraska; <br />said mortgage being filed for record on February 13, 1952 in Book 95, Pa ;7e 157 <br />of the Mortgage Records of Hall County, Nebraska, and <br />WHEREAS, TIE PRUDENTIAL INSURANCE C('PANY OF LVEEI CA, party of the second <br />part did declare an acceleration of the indebtedness represented by said note <br />under the option contained in said note and did under date of June 14, 1958 <br />file a notice of his Pendens and a petition to foreclose said mortgage; and <br />JiP,R aS, said parties of the first part have subsequently paid the delin- <br />quencies existing under said mortgage indebtedness; and <br />IiTH ;REAS, under date of July 7, 1958 said party of the second part filed <br />a 2 °iotion to Dismiss said foreclosure without prejudice; <br />NOW, TFEOREFORE, in consideration of the payment of said mortga (-;e loan <br />delinquencies and in consideration of the reinstatement of said loan, according <br />
