EASEMENT AND AGREEMENT
<br />THIS AGREEMENT entered into by and between James J. Cochnar and
<br />Anna M. Cochnar, husband and wife, parties of the first part, and
<br />Robert Starr Spangenberg, party of the second part; WITNESSETH,
<br />that
<br />WHEREAS, the parties of the first part are the owners of a tract
<br />of land consisting of the Northerly portion of Lot Four (4), Block
<br />Thirty -Two (32), Original Town of Grand Island, more particularly
<br />described as follows: Vf
<br />Beginning at a point in the West line, One Hundred Three and Six
<br />Tenths (103.61) feet. Southerly from the Northwest Corner of said
<br />Lot Four (4), thence Northerly One Hundred Three and Six Tenths
<br />(103.61) feet to the Northwest Corner,' thence Easterly Sixty -Six
<br />feet(66.01) along the North line of Lot Four °(4) to the Northeast
<br />corner, thence Southerly One Hundred,Three and Three Tenths feet
<br />(103.31) along the East line of Lot Four (41 to a point, thence
<br />Westerly Sixty -Six feet (66.01) to the point of.beginning - being
<br />located in the Northeast Quarter (NE.), of the Northeast Quarter (NE4),
<br />Section Sixteen (16), Township Eleven (11) North, Range. Nine (9)
<br />West of the 6th P.M., Hall County, Nebraska,
<br />and Robert Starr Spangenberg, party of .the second part, is the
<br />owner of the remainder or the .,`Southerly portion of Lot Four (4),
<br />Block Thirty -Two (32), Original Town of Grand Island, more particu-
<br />larly described above.
<br />IT IS HEREBY MUTUALLY AGREED that the said Robert Starr Spangenberg,
<br />his heirs, assigns and all persons claiming title by, through and
<br />under him, shall have an easement and right -of -way across the North-
<br />erly part of Lot Four (4), more particularly described above,,for
<br />the purpose of maintaining water and gas that are now.presently
<br />located thereon.
<br />IT IS FURTHER MUTUALLY AGREED that James J. Cochnar and Anna M.
<br />Cochnar, parties of the first part;. their heirs, assigns and all
<br />persons claiming title by, through and under them, shall have an
<br />easement and right -of -way across the Southerly part of said Lot
<br />Four (4), more particularly described above, for the purpose of
<br />maintaining the sewer that is now presently located thereon.
<br />IT IS FURTHER AGREED by both parties that any damage or replace-
<br />ments that may be necessary by reason of maintaining water, gas and
<br />sewer shall be paid by the party causing such damage.
<br />This agreement is binding upon the heirs, assigns and grantees of
<br />the parties herein and shall operate as an easement running with
<br />the land to the extent hereinbefore referred to.

<br />a notary public in and for Hall County, Nebraska,
<br />James J. Cochnar, Anna M. Cochnar, husband and

<br />persons whose names are affixed to the above instrument
<br />'thereto, and they and each of them acknowledged said in-
<br />be their voluntary act and deed for the purposes therein
