' In the Matter of the Title to Block Fourteen (14) and <br />the West Half (WZ) of Block Fifteen (15) in Pleasant <br />Home Subdivision, being part of the East Half of the <br />Southeast Quatter (EZSEk), Section Twenty -one (21), <br />Township Eleven (11) North, Range Nine (9), West of <br />the 6th P.M., Hall County, Nebraska <br />J <br />STATE OF NEBRASKA ) <br />(SS: A F F I D_A V I T <br />COUNTY OF HALL ) <br />PHILIP J. ROSE, of Grand Island, Nebraska, being <br />first duly sworn deposes and says that he is a resident of <br />Grand Island, Nebraska; that he is I°3 L I°3 years of age. <br />Affiant further states that he is a son of John <br />Rose and Josephine Rose, both of whom are deceased; that <br />Josephine Rose, mother of affiant, obtained title to the <br />above described premises on March 14, 1911 by warranty deed <br />recorded in Book 48 at page 321 of the Deed Records of Hall <br />County, Nebraska; that all of said property descended to <br />the heirs of Josephine Rose and John Rose, both deceased; <br />that affiant herein was an owner of part of the above <br />described premises on November 17, 1946; that he received <br />title to the remainder of said premises by warranty deed <br />dated November 17, 1946, recorded in Book 93 at page 527 <br />of the Deed Records of Hall County, Nebraska; that affiant <br />and his wife were the joint owners of the above described <br />premises up until March 6, 1951, at which time they sold <br />part of the above premises to John E. Gedstead and Ellen Gedstead <br />by deed, recorded in Book 102 at page 43 of the Deed <br />Records of Hall County, Nebraska. <br />Affiant further states that the heirs at law of <br />Josephine Rose and John Rose were in possession of said <br />premises at all times after the death of the said John Rose <br />and Josephine Rose with the exception of an undivided in- <br />terest therein which was conveyed to J. Jay Marx, which in- <br />terest was conveyed by J. Jay Marx and Lottie Marx by quit <br />claim deed recorded in Book 83 at page 701 of the Deed. <br />Records of Hall County, Nebraska. <br />Affiant further states that from the date that his <br />mother, Josephine Rose, obtained title to said premises, to- <br />wit: March 14, 1911 and up until the date that he conveyed <br />part of Block 14 to John E. Gedstead and Ellen Gedstead on <br />March 6, 1951 that no person or persons, corporation, par- <br />tnership or other individual claimed to have any interest <br />in or to.any of said premises except the heirs of Josephine <br />Rose and John Rose; that Josephine Rose departed this life <br />
