AGREEMENT FOR SALE OF REAL PROPERTY <br />This agreement is entered into between William B Hamilton and Mabel A Hamilton <br />of Alda; Nebraska each in his and her own right and as spouse of the other and as the VENDORS, <br />Carl L. Smith Jr. and <br />and, mi of Grand Island, ��gb.ag�sa s A� PURCHASERS <br />EdItri M. <br />The vendors sell, and the purchasers agree to buy the following described property: <br />�in ihenceonorth 150 <br />Beginning at the southeast corner of Block Four (4),� <br />feet, thence west 50 feet, thence south 150 feet, thence east 50 feet to place <br />of beginning all in Alda, Nebraska. <br />Also including the propane tank and venetian blinds. <br />in Hall County and the State of Nebraska, together with all appurtenances thereunto belonging and now thereon. except <br />and subject to any building restrictions or easements of record against such real property on the date of this agreement. <br />The purchasers agree to pay for such real property the aggregate sum of <br />Eighty Six Hundred and No./loo - - - - - - - - - - - - - - Dollars ($,8600.00 ) <br />payable as follows: $�20 -nn , receipt of which is hereby acknowledged; $ =1146.05 — on or before Septrmber7,19-57nd, the balance of $ 6453.95 with interest at the rate of —6` per cent <br />( -6 — %) per annum, to be paid at the office of B. F. Douthit in the First National Bank Building in Grand Island, Ne- <br />braska, or at such other place as the vendors may hereafter designate in writing, in monthly installments of <br />Sid y Dollars ($_ 60-00 ) commencing flrtoher 1, 195'7 , and on the 1st <br />day of each month thereafter until such balance of purchase price and the interest thereon shall be paid in full. <br />Vendors agree to pay a prorata portion of the 1957 realestate tax to September 7, 1957 <br />using the amount of the 1956 realestate tax on these premises as a >basis of calcula- <br />tion. <br />The purchasers shall have the privilege, on any installment payment date hereunder, of paying the unpaid balance of such <br />purchase price and interest thereon to the date of such payment, and advances, if any, made by vendors for taxes or insur- <br />ance with interest thereon to date of such payment. <br />It is expressly stipulated and agreed that the vendors will submit herewith to the purchasers an abstract of title certi- <br />fied to date and that the purchaser shall inform the vendors within ten days from the'date of this contract as to the opinion <br />of the attorney for the purchasers regarding the merchantability of the title of the vendors to such real property as shown <br />by such abstract of title. <br />Vendors agree upon payment.of the full purchase price, interest, and advances, if any, for taxes or insurance, that the <br />vendors will again have such abstract of title certified to that date to show merchantable title to such real property in the <br />vendors free of any encumbrances and liens incurred by vendors but subject to building restrictions and easements of record <br />on the date that this contract is entered into and further subject to all encumbrances and liens incurred-by or permitted <br />thereon by purchasers. <br />The vendors further agree upon the execution of this agreement by the parties hereto to place IN ESCROW with such <br />B. F. Douthit, together with a copy of this contract, a warranty deed conveying such real property to purchasers, free and <br />(hear of encumbrances except the 19_9-7— and subsequent real property taxes and any building restrictions and easements <br />of record to date of this agreement and further subject to any encumbrances and liens incurred by or permitted thereon by <br />purchasers, and the vendors herein hereby authorize such escrow agent to deliver such warranty deed to the purchasers up- <br />on payment by the purchasers in full of the purchase price, interest, and advances, if any, by vendors for taxes or insurance, <br />with interest. <br />The vendors agree to pay for the required Federal documentary stamps when the deed is delivered and authorize the <br />escrow agent to pay for such documentary stamps out of any monies of vendors in his hands. <br />IT IS FURTHER AGREED that purchasers shall be given possession of such real property on September 7, 1957 <br />provided, however, payment of the total sum of $--2146-05- as herein provided for has <br />been made by the purchasers.- <br />
