improvements, furniture, fixtures,machinery and equipment owned by it <br />and located on a tract of land near Grand Island, Nebraska, leased by <br />first party from the Union pacific Railroad company under Lease Number <br />38399, and <br />WHEREAS, under the terms of said sale, first party hasagreed <br />to astign to second party a certain Lease Agreement dated September 13, <br />1955 between Alvin Busboom and Helen Busboom, husband and wife, and first <br />pariyherein, covering a roadway to be used for entrance to and exit from <br />the premises leased by first party hereunder frcmthe Union pacific Rail- <br />road Company under Lease Number 38399, <br />NOW, THEREFORE, as a part of the consideration for the sale <br />of first partyts personal property to second party, referred to above, <br />and for other good.and valuable considerations, first party does hereby <br />assign to second party, without recourse, the aforesaid Lease Agreement <br />dated September 13, 1955 between Alvin Busboom and Helen Busboom, husband <br />and wife, Lessors, and Fairmont Foods Company, Lessee. In accordance <br />with the terms of said lease, which also contains an Option to purchase, <br />this Assignment shall vest in International Milling Company all of <br />Fairmont Foods Company's rights in said Lease Agreement, and this Assign- <br />ment is made subject to the condition that all obligations of Fairmont <br />Foods Company in said Lease Agreement shall be assumed by and be binding <br />upon International Milling Company. <br />IN WITNESS WHEREOF, Fairmont Foods Company has caused this <br />Ft�nt to be executed in its corporate name by its duly authorized <br />and its corporate seal to be hereunto affixed this 24th day of <br />T <br />+��.'
