STATE OF NEBRASKA ) <br />(SS: AFFIDAVIT <br />COUNTY OF HALL ) <br />MAE KUTSCHKAU, being first duly sworn on oath; states <br />as follows: <br />That she was one of the grantors of a warranty deed <br />which conveyed Lot "C" of Lot 10 of Stehr's Subdivision lo- <br />cated on part of the West Half of the Southwest Quarter of <br />Section 11, Township 11, North, Range 9, West of the 6th <br />P.M., Hall County, Nebraska, to Clifford Eugene Kutschkau <br />and Esther Kutschkau, which deed was recorded July 16, 1957 <br />in Book 121 at page 533 of the Deed Records of Hall County, <br />Nebraska;'that through an error "of omission part of the prop- <br />erty conveyed was described as "thence proceeding in a South- <br />easterly direction parallel with the West line of said Stehr's <br />Subdivision a distance of 90 feet" but that said description <br />should have read-and was intended to read "parallel with the <br />West line of said Lot 10 of said Stehr's Subdivision,.., a dis- <br />tance of eet. <br />Affiant further states that it was the intention of <br />the grantors to convey Lot "C" of Lot 10 of Stehr's Sub- <br />division (as described in plat of Stehr's Subdivision, record- <br />ed in Book 81, page 415, Hall County, Nebraska), same being <br />located upon"a part of the West Half of the Southwest Quarter, <br />Section 11, Township 11, North, Range 9, West of the 6th P.M., <br />Hall County, Nebraska, commencing at a point 44 feet north- <br />east of the northwest corner of Lot 10 of Stehr's Subdivision, <br />thence proceeding in a Southeasterly direction parallel with <br />the West line of said Lot 10 of Stehr's Subdivision, a dis- <br />tance of 90 feet, thence in an Easterly direction a dis- <br />tance of 64.8 feet, thence in a Northerly direction a dis- <br />tance of 131 feet to a point on the Northerly line of said <br />Lot 10, thence in a Southwesterly direction along and upon <br />the North line of Lot 10 a distance of 115 feet to the place <br />of beginning, the same being a tract of ground with a 115 <br />foot frontage on Highway 30. <br />Affiant further states that Emil Kutschkau her hus- <br />band, the other grantor of said described deed, died at Grand <br />Island, Nebraska on the %20 day of J ri NL� 1956. <br />r, D <br />Subscribed and sworn to before m this a Al ,- <br />July, 1957.: d,dx <br />�f NOTARVPUBL <br />� f <br />My commission expires:-- -"August 17, 195.7. <br />Filed for record July 24, 1957 at 3:15 P.M.&,,_�(.
