<br />Anthony Meseraull, being first duly sworn, on oath deposes
<br />and says that he has been a resident of Doniphan, Hall County,
<br />Nebraska, for many years last past; that he is well acquainted
<br />with Frank Scudder, who is grantee in a deed to all of Lot
<br />Eleven of the County Subdivision of the South Half (SJ) of
<br />Section Five (5) in Township Nine (9) North, Range Nine (9),
<br />West of the 6th P.M., except that portion of said Lot 11,
<br />commencing at the Northeast corner of said Lot 11, and running
<br />West at right angles with the East line of said Lot 11, 105•
<br />feet; thence South at right angles, 125 feet; thence East at
<br />right angles 105J feet to the East line of said Lot 11; thence
<br />North along East line of said Lot 11, 125 feet to the place of
<br />beginning, dated August 5, 1941, acknowledged August 5, 1941,
<br />and filed for record in the office of the Register of Deeds of
<br />Hall County, Nebraska, on the 9th day of February, 1948, in
<br />Book 89 of Deeds at Page 685, and that he is one and the same
<br />person, despite the discrepancy in names, as Benjamin F. Scudder,
<br />who is mentioned as grantor in a warranty deed to Albert D.
<br />Burger and Claribel Burger, his wife, wherein he conveys that
<br />part of Lot Eleven (11) of the County Subdivision of a part of
<br />the south half of Section Five (5), in Township Nine (9), North,
<br />Range Nine West of the 6th P.M., more particularly described as
<br />follows: Beginning at a point 125 feet south of the northeast
<br />corner of said Lot 11, and running thence West, at right angles,
<br />with the East line of said Lot 11, 105' feet; thence South, at
<br />right angles, 193J feet; thence East, at right angles, 1052 feet
<br />to the East line of said Lot 11; thence North, along said East
<br />line, 193J feet to the place of beginning, said deed being dated
<br />December 14, 1945, acknowledged December 14, 1945, and filed for
<br />record in the office of the Register of Deeds of Hall County,
<br />Nebraska on the 13th day of April, 1946, in Book 91 of Deeds at
<br />Page 53. Said real estate last described being a part of the
<br />real estate conveyed to the said nk Scudde August 5,pn1941.
