<br />ASSIGNMENT OF RENTS
<br />KNOW ALL MEN BY THESE PRESENTS: that the undersigned Dale R. Spiehs and Twila J.Spiehs,
<br />husband and wife, each in his own right and as spouse of the other,of Grand Island,
<br />Hall County, Nebraska for and in consideration of the loan of Seven Thousand Dollars
<br />(7,000.00) in hand paid by The Midwest Life Insurance Company of Lincoln, Nebraska
<br />and other good and valuable consideration, the receipt whereof is hereby acknowledged,
<br />do hereby assign, transfer and set over to The Midi -Test Life Insurance Company of
<br />Lincoln, Nebraska as collateral security for said loan, for so long as said loan or
<br />any part thereof remains unpaid, the rents and revenue accruing for the period of the
<br />duration of the loan above mentioned, on the following described property situated in
<br />the County of Hall, State of Nebraska, to -wit:
<br />Lot Six (6) in Block Four (4) in Schimmer's Addition to the
<br />City of Grand Island, Nebraska,
<br />and we hereby authorize and empower The Midwest Life Insurance Company of Lincoln,
<br />Nebraska, its authorized agents and attorneys to act for us and .rent the above de-
<br />scribed premises or any part thereof, and in our place collect and receipt for said
<br />rents, either monthly, quarterly, or annually as they may see fit, and in default of
<br />the payment of said rent or any part thereof to proceed in its own name by suit or
<br />suits at law for the recovery thereof in such manner as it shall deem fit.
<br />This assignment of rents is made for the express purpose of having the rent collected
<br />hereunder applied to payment of taxes, principal and interest on the loan of
<br />$7,000.00 above described, as agreed by the undersigned to said Company in the
<br />note in the sum of x',7,000.00 and the real estate mortgage on the property above
<br />described securing said note.
<br />S:zid Company, in its discretion, may use the rents so far as necessary fo she
<br />purpose of making such repairs upon the premises as, in its judgment, may be proper
<br />and may use said rents so far as necessary for the payment of insurance premiums
<br />and taxes upon said premises, or any other payment to be made by the undersigned
<br />under the terms of the note and mortgage above mentioned, the balance to be applied
<br />upon the principal payment and interest on said. note and loan.
<br />This assignment and transfer of rents and -revenue is to be absolute to the extent
<br />of the total of the payments above mentioned from and after this date. In no event
<br />shall said Company, in connection with its possession and management of said
<br />premises, be required to apply or account for more than the rents and profits actually
<br />collected and received by it, less reasonable expenditures made by it to maintain or
<br />improve said premises.
