E A S E M E N T
<br />THIS AGREEMENT, made this-L3 day of ( �� <� 19`x~' ,
<br />by and between John W. Detweiler and Claire . Detweiler, husband and
<br />wife, herein called the "Grantors ", and Metropolitan Life Insurance
<br />Company, a corporation, herein called the "Grantee ", WITNESSETH:
<br />WHEREAS, the Grantors are the owners of a property herein described,
<br />and have executed and delivered a mortgage on the North 60 feet of Lot
<br />Eight (8) and the East 22 feet of the North 60 feet of Lot 7, Block 107,
<br />in Railroad Addition to the City of Grand Island, Nebraska, which mort-
<br />gage was filed for record on November 21, 1955 and recorded in Book 110,
<br />Page 547 of the mortgage records of Hall County, Nebraska;
<br />NOW, THEREFORE, the Grantors do hereby grant, give and convey to
<br />Metropolitan Life Insurance Company, its successors and assigns, an
<br />easement over the South 6 Feet of the North Half of Lot 8, and the
<br />South 6 Feet of the East 22 feet of the North Half of Lot 7, Block 107,
<br />Railroad Addition to the City of Grand Island, Nebraska, with the right
<br />of ingress and egress over and ,across said 6 feet strip, for the pur-
<br />pose of maintaining and repairing the South wall and rest of the build-
<br />ing located on the North 60 feet of Lot 8 and the North 60 feet of the
<br />East 22 feet of Lot 7, in Block 107. This easement shall terminate:
<br />1. If the Grantors erect a building equal to or greater in
<br />height than the building on the mortgaged property, and if said build-
<br />ing abuts against the South wall of the building on the mortgaged
<br />premises.
<br />2. Upon payment by the Grantors to Metropolitan Life Insur-
<br />ance Company, or its assigns, of all sums due or to become due by reason
<br />of said mortgage, and a release of said mortgage shall. operate as a re-
<br />lease and extinguishment of this easement.
